China's New Copyright Law Reforms: A Comparative Analysis, Shruti Rana, Garland Rowland
China's New Copyright Law Reforms: A Comparative Analysis, Shruti Rana, Garland Rowland
Shruti Rana
Nations and businesses around the globe have been battling over copyright protection rules, with industrialized nations pressuring developing nations to adopt Western-style copyright regimes. These battles have escalated as copyright piracy grows and developing nations struggle to formulate laws that will protect their own intellectual properties as well as those of industrialized nations. China is at the cutting edge of these debates; in the summer of 2012, China released transformative new proposals to modify its copyright rules. This Article, which we believe is the first in-depth academic piece analyzing China’s new reforms, critiques China’s new proposals and argues that China …

Enforcing European Corporate Commitments To Freedom Of Association By Legal And Industrial Action In The United States: Enforcement By Industrial Action, Lance A. Compa, Fred Feinstein
Lance A Compa
[Excerpt] We believe it is important to discuss industrial action as one way to enforce commitments to abide by international labor standards in part because of the challenges of "hard" law enforcement, not only in an international context but also in the enforcement of domestic labor policies. Because of the challenges presented by "hard" enforcement of labor policy in both the domestic and international context, it is important to examine the dynamics that initially motivate the adoption of IFAs and other commitments to abide by international labor standards as an important aspect of their enforcement. What unions and other advocates …

Rank-And-File Participation In Organizing At Home And Abroad, Lowell Turner

[Excerpt] We know that we need labor law reform. But it is also clear that this is not all we need; nor can we expect to achieve legal reform simply by electing Democrats. That strategy did not work in 1978-79 or in 1993-94, and it will not work in the future. In the face of inevitably powerful and well-organized business opposition, even the most well-financed and articulate lobbying campaign for labor law reform can fail. What was missing in 1978-79 and in 1993-94 and is urgently needed now is the pressure of a massive social movement, mobilized to transform and …

This article examines two of the major water legal regimes in theAmericas—that of Brazil and the United States. Both countries haveextensive wet and dry regions and both hydro-regimes face a significantthreat from global warming. Brazil, for instance, is home to betweeneight and fifteen percent of the world’s fresh water, and its fast-growingeconomy and population present major challenges in management andallocation. The U.S. also faces major water allocation problems resultingfrom past settlement policies; unsustainable reclamation projects; andalso fast-growing domestic, industrial and agricultural demand. In the United States, water has traditionally been perceived as arenewable and limitless resource, a cultural legacy that …

Get Busy Living Or Get Busy Dying: Waiting For The Death Penalty, A Comparison Of The Appeals Process In The United States And The People’S Republic Of China, Derrick Yan Kit Wong
Derrick Wong
This paper looks at the death penalty in the United States and China with a comparison of the judicial system in each country. The paper examines the speed at which China processes their death penalty cases and the delay in the US system. The purpose of the paper is to show that because of the delays in the US system, the financial burden to the taxpayer is increased and is not viewed as deterrence. If the US were to adopt a portion of the Chinese judicial system efficiency without sacrificing due process, then the death penalty can be a deterrent …

Gerechtigkeit Ohne Gewerkschaft Und Betriebsrat? Konfliktschlichtung In Gewerkschaftsfreien Betrieben In Den Usa, Alexander Colvin
Alexander Colvin

This national benchmarking report of the U.S. telecommunications services industry traces the tumultuous changes in management and workforce practices and performance in the sector over the last 5 years. This is a follow-up report to our 1998 study. At that time, when the industry was booming, we conducted a national survey of establishments in the industry. In 2003, we returned to do a second national survey of the industry, this time in a sector that was recovering from one of the worst recessions in its history.

A Comparative Study On Human Embryonic Stem Cell's Patent-Eligibility In The United States, The European Patent Organization And China, Huan Zhu
Huan Zhu
Since human embryonic stem cells (hESCs) have entered the public’s view, a large number of ethical debates and moral concerns have been generated. However, these concerns have not stifled advances in biotechnology regarding hESCs. Thanks to its scientific potential and therapeutic values, scientists from all over the world contribute both funding and time to investigate hESCs and additionally seek protection for their research inventions and methods. The patent system is a known mechanism to provide this protection and promote science by granting the patentee exclusive rights to the inventions while requiring public disclosure. However, due to the intrinsic relation of …

On February 23, 2011, the Obama Administration announced that it would no longer defend the constitutionality of the Defense of Marriage Act. Of great significance in this announcement was the Administration’s position that classifications on the basis of sexual orientation warrant heightened judicial scrutiny. Notwithstanding this announcement, the level of review applied to sexual-orientation classifications—and the manner in which a court determines whether a particular type of classification deserves more searching review—is an open question, the answer to which typically dictates the outcome of challenges to government classifications. Apart from this outcome determinativeness, affording heightened scrutiny to some classifications but …

Power, Pragmatism And Prisoner Abuse: Amnesty And Accountability In The United States, Louise Mallinder
Louise Mallinder
America’s commitment to human rights and the rule of law has long been an integral part of the nation’s self-image as an idealistic and inspirational society. It has been substantiated in the United States’ promotion of the rule of law around the world. However, as has been extensively scrutinized in recent years, the lackluster pursuit of accountability for the widespread abuses committed by American personnel during the so-called “War on Terror” illustrates a disjuncture within domestic and international discourse between the dual perceptions of the United States as a law-abiding nation, and America as a law-breaking state. This article seeks …
