The Act also changes the conditions under which the Department of Human Resources accepts applications for support enforcement services, provides for reimbursement of the department for attorneys' fees, and authorizes the collection of interest on judgments initiated by the department. This equipment can be used only by permit-holders and when prior permission of the recipient is obtained, with certain exceptions, and only between certain hours. The Act amends the provisions of the Code which prohibited the compulsion of testimony from one spouse against another in criminal proceedings. It provides that spouses may be compelled to testify against each other in proceedings in which the husband or wife is charged with a crime against a minor child. A spouse can be compelled to give evidence only as to the specific act for which the defendant is charged. April 16, 1987

The Act amends the Code provision relating to the right of parents to recover in tort for the homicide of a child. If the parents are married and living together they shall divide any judgment equally; but if they are divorced, separated, or living apart, either parent may file a motion prior to trial requesting the judge to apportion any judgment amounts. If no motion is filed, the judgment shall be divided equally. Each parent may present evidence at a post-judgment hearing held to decide the motion for apportionment. The Act mandates that a convicted felon under age seventeen who is sentenced as an adult be committed to the Division of Youth Services of the Department of Human Resources until he or she reaches age eighteen whereupon transfer of responsibility for the inmate is made to the Department of Corrections. The Act deregulates banking laws governing bank credit cards issued in Georgia. Deregulation is accomplished by eliminating the eighteen percent ceiling on interest rates, the twelve dollar annual fee limit, and other rate and fee limitations on credit cards issued in Georgia. The Act amends the current statutory provisions mandating evidentiary hearings in divorce actions. While evidentiary hearings are still authorized, now uncontested divorces can also be granted by the court based either on the verified pleadings, affidavits or &"such other basis or procedure as the court may deem proper in its discretion.&" The waiver of a required evidentiary hearing applies also to issues of alimony, child support, and child custody when those issues are uncontested. The new statutory provisions apply to all proceedings either pending on or commenced after July 1, 1987. July 1, 1987
