Sprawl, Growth Boundaries And The Rehnquist Court , Michael E Lewyn

This article addresses the constitutionality and wisdom of Oregon's urban growth boundary (UGB) program. The article concludes that the program is constitutional under current precedent, and that (contrary to claims made by UGB critics) there is little evidence that the UGB has caused Oregon's runup in housing prices. On the other hand, UGB supporters may have exaggerated the UGB's positive environmental results.

Sustainable Development: Now More Than Ever, John C. Dernbach

This Article explains how and why sustainable development emerged as a conceptual framework, the basic concepts or principles on which this framework is based, why sustainability is primarily a matter for domestic national governance, and why the United States needs to play a leading role in fostering sustainable development. Because "sustainable" modifies "development," it is first important to understand what development means. Since the end of World War II, development has included at least four related elements: peace and security, economic development, social development, and supportive national governance. Major Terrestrial Causes Of Marine Coastal Pollution: A Critique Of Current Regulation And The Suggestion Of An Alternative Approach To Regulation, Chad J. Mcguire

The purpose of this article is to identify agricultural operations as the major source of marine pollution, and present an argument for an alternate regulatory mechanism to properly control these sources. First, causes of marine pollution will be identified. Then, existing federal regulations will be reviewed and criticized. Some emphasis will be placed on §303 of the CWA, and the Total Maximum Daily Load (TMDL) program suggested by EPA. It will be used as a case study to show why ambient-based regulations are ineffective at controlling pollution sources. Limitations on other regulatory programs will be identified and explained.
