The organizational structure of Chinese prosecutor’s organs reflects country’s historical traditions and legal system, and thus it clearly differentiates from other jurisdiction in the world, especially the jurisdictions of the common law legal system. The article starts with the constitutional grounds for prosecutor’s activities, and focuses on the major developments in the structure and powers of Chinese prosecutor’s Organs. The changes are analysed that took place with the creation of the National Supervisory Commission, when the power of investigation of duty crimes of the prosecutor’s organs has been taken away. The time scale of criminal law rule is determined according to its beginning moment and its end moment. The problem which arises is validity of these rules in terms of time when several rules dealing with the same subject come into force respectively. This issue arises specifically in a limited period of time between the date of the crime committed and the date of the final judgment issued. Under U.S. House precedent, any member-elect can challenge the right of
any other member-elect to take the oath of office at the beginning of a new term.
The uncontested members-elect then swear in and decide the fate of those who
were forced to stand aside. If the House is closely divided and there are
disputed elections at the margins, a minority party could exploit this procedure
to try to seize control of the House.
