Beyond Westphalia: Competitive Legalization In Emerging Transnational Regulatory Systems, Errol E. Meidinger

Published as Chapter 7 in Law and Legalization in Transnational Relations, Christian Brütsch & Dirk Lehmkuhl, eds.
This paper analyzes several emerging transnational regulatory systems that engage, but are not centered on state legal systems. Driven primarily by civil society organizations, the new regulatory systems use conventional technical standard setting and certification techniques to establish market-leveraged, social and environmental regulatory programs. These programs resemble state regulatory programs in many important respects, and are increasingly legalized. Individual sectors generally have multiple regulatory programs that compete with, but also mimic and reinforce each other. While forestry is the most developed example, similar …
The Business Of Being Good: How It Pays To Be A Humanitarian State, Taylor Benjamin-Britton, Danielle Scherer
The Business Of Being Good: How It Pays To Be A Humanitarian State, Taylor Benjamin-Britton, Danielle Scherer
Biennial Conference: The Social Practice of Human Rights
In an era where human rights increasingly take a position of primacy in international relations, certain states have donned the mantle of the humanitarian, prioritizing human rights over nearly every other item on the foreign policy agenda and mainstreaming humanitarianism in other areas of foreign policy.
Existing arguments find that states that advance humanitarian policies are coerced, socialized, or mimicking, but they fail to seriously consider that states may choose and benefit from humanitarianism in several ways. We do not focus on explaining or theorizing why states have chosen to engage in humanitarianism; rather, we offer an analysis of the …

Felix is originally from Nigeria and has now been inItaly under a year. He came from a family with a polygamous father who “married” multiple wives illegally. After returning home from a service mission for his church, which his father supported, Felix began to study engineering. At some point conflict arose within the family that causedFelix to have to flee.He was smuggled through Niger to Libya, losing several friends along the way. There he was held for ransom, before taking a treacherous voyage across the sea in an overfilled boat, where he witnessed several drown. Now he lives in a camp …

Sensors Everywhere: Using Satellites And Mobile Phones To Reduce Information Uncertainty In Human Rights Crisis Research, Christoph Koettl
Genocide Studies and Prevention: An International Journal
This article critically reviews the use of ICTs for human rights crisis research. While focusing on two specific technologies—satellite imagery and mobile phone technology—it proposes a general framework for analyzing the added value of ICTs. The author suggests that their added value in mass atrocities research arises from their ability to reduce information uncertainty, a challenge that is exacerbated in the digital age. This is different from delivering “truth”, an inaccurate description that only leads to unfulfilled expectations and hopes. The article is written from a practitioner’s perspective, drawing from the work of a global human rights watchdog, thus avoiding …

The Research and Scholarship Symposium (2013-2019)
The goal of this presentation is to take a look into the human rights violation of child marriage happening in countries all over the world. For the purpose of this presentation, we will focus on four countries where child marriages are extremely prevalent: India, Niger, Bangladesh, and Yemen. First, we will begin with a brief history and background of child brides and statistics related to this population. Second, we will discuss the four countries (as stated above) where this is a major problem, and why the rates of child brides are especially high within each country. Third, we will consider …

[Introduction To] Dismembered: Native Disenrollment And The Battle For Human Rights, David E. Wilkins, Shelly Hulse Wilkins
Bookshelf
While the number of federally recognized Native nations in the United States are increasing, the population figures for existing tribal nations are declining. This depopulation is not being perpetrated by the federal government, but by Native governments that are banishing, denying, or disenrolling Native citizens at an unprecedented rate. Since the 1990s, tribal belonging has become more of a privilege than a sacred right. Political and legal dismemberment has become a national phenomenon with nearly eighty Native nations, in at least twenty states, terminating the rights of indigenous citizens.
The first comprehensive examination of the origins and significance of tribal …

The Black Women Anti-Defamation Coalition: A Proposal For The Remediation Of The Negative, Controlling Images Of Black Women, Shemar Antonio Taylor
Senior Projects Spring 2017
This research sets out to highlight the life-altering degree to which negative, domineering depictions of Black women has had and continues to have on their livelihood and also to argue that due to their systemic inability to control and craft their own reputation, this should be categorized as a human rights violation and enforced on the grounds of defamation law. Although I am not a Black woman myself, as a Black man who was raised by three Black women, I have seen first hand the importance of proving this point. Many Black women scholars, many of whom I will be …

Qué Tan Lejos Hemos Ido Y Qué Tan Lejos Nos Queda: Los Niños Trabajadores Y La Erradicación Del Trabajo Infantil En Ecuador, Alicia Serna Frausto
CMC Senior Theses
Older Indigent Women’S Economic Crimes: Subsuming Feminism In Favour Of A Human Rights Explanation, Patricia Joan Rhodes
Older Indigent Women’S Economic Crimes: Subsuming Feminism In Favour Of A Human Rights Explanation, Patricia Joan Rhodes
Theses: Doctorates and Masters
Many people today believe the concept of gender inequality is outmoded, irrelevant and unnecessary in Western societies that are deemed egalitarian. As a consequence, feminism as a movement with gender equality at its core has often been proclaimed ‘dead’,a relic of the past. Feminist perspectives, nevertheless, have produced differing points of view about the sources of gender inequality affecting crime rates and criminal behaviour.
For the last 50 years or so, women and girls have been the subject of criminological research that has largely evolved from sociological perspectives and specifically from feminism. Although gender intersects with other social realities and …
