Common Law's Lawyering Model: Transforming Individual Crises Into Opportunities For Community Organizing, Karen Gargamelli, Jay Kim

We are alumni of the City University of New York School of Law, Class (“CUNY Law”) of 2007 and founders of Common Law, an organization that uses legal education and legal services to support and increase organizing and activism. We describe the origins of Common Law and our beginnings as an organization providing direct legal services to members of community organizing groups in Section I; the emergence of our unique legal clinic model supporting pro se (self-represented) litigants fighting foreclosure in Section II; and our challenges and hopes for the future in Section III.

Hélie & Ashe law review writing raises and responds to a reformulated and broadened version of Susan Okin’s 1999 inquiry, Is Multiculturalism Bad for Women? It identifies social and political developments, as well as legal and theoretical developments, that have occurred in the 21st century and that demand that reformulation.

Weaponizing Tear Gas: Bahrain’S Unprecedented Use Of Toxic Chemical Agents Against Civilians., Richard Sollom, Holly G. Atkinson

The Bahraini government’s response to the early 2011 pro-democracy protests was brutal, systematic, and violent. In addition to birdshot and rubber bullets, government law enforcement attacked unarmed protestors with toxic chemical agents including tear gas. The government’s crackdown on the medical profession was especially harmful, as security forces arrested and detained doctors, raided health facilities, and obstructed patients from receiving necessary care. This report’s findings are based on field research that the authors conducted in Bahrain (April 2012) to investigate excessive use of force by law enforcement officials since June 2011—the end of Bahrain’s state of emergency. This analysis seeks to explore the unexamined question of whether the Racketeer Influenced and Corrupt Organizations Act (“RICO” or “The Act”) could one day become a useful surrogate for the Alien Tort Statute (“ATS”) in litigating international corporate abuses. Decades after the ATS became a robust tool for bringing claims for international violations in U.S. courts, the U.S. Court of Appeals for the Second Circuit recently ruled in Kiobel v. Royal Dutch Petroleum Co. that corporations cannot be held liable for torts in violation of the law of nations under the ATS.Rulings by the D.C Circuit and the Seventh Circuit …
