After her substantive and procedural due process claims were dismissed in the Supreme Court, Jessica Gonzales took the unprecedented step of filing a claim with the Inter-American Commission of Human Rights, the first time such an allegation of human rights violations had been brought against the United States. Gonzales’ case has implicated two hot-button issues in modern United States jurisprudence: domestic violence prevention and the role of international law in domestic courts.
