We have experienced nothing short of an explosion in competition law enactment and enforcement over the last several years. Today, more than eighty countries have competition laws, with the majority of these enacting competition legislation for the first time in the 1990s. With these new laws come new, or in some cases renewed, enforcement efforts against commercial behavior viewed as posing threats to the competitive process. Even in jurisdictions that have developed a tradition of competition law enforcement, like the European Community and the United States, the influence of competition law in everyday commercial decision-making has increased dramatically.

Rethinking Wto Trade Sanctions, Steve Charnovitz

The paper presents an outline of the issues and a preliminary appraisal of the use of trade sanctions by the World Trade Organization (WTO) as a means of promoting compliance by parties. The WTO is unique among intergovernmental organizations (IGOs) in using trade sanctions to enforce independent adjudications. Many commentators have suggested using trade sanctions analogously in other IGOs, or alternatively broadening trade rules so that the sanctions can be used for other purposes, such as enforcing basic human rights. This paper examines the current conflicts surrounding the implementation of patent protection for pharmaceuticals. Part II outlines the specifics of trade agreements shaping the global intellectual property regime and the consequences for governments seeking to devise an essential drugs policy. Part III analyzes the process of obtaining consensus and compliance with patent protection rules through the negotiation and implementation of trade agreements, and the utilization of dispute settlement mechanisms. Recently, Switzerland has proposed a law that would significantly tighten its regulation of the antiquities trade. The draft law seeks to comport Swiss law with the broad goals of international conventions on the protection and transfer of cultural property. However, given Switzerland's past reluctance to curtail the illicit trade in antiquities, it remains unclear whether this measure will pass or if passed, whether the law would be adequately enforced.
