Domestic Relations Alimony And Child Support Generally; Enforcement Of Duty To Support; Parent And Child Relationship Generally, Jaimie Johnson

The Act makes sweeping changes to Georgia's child and spousal support enforcement procedures by shifting the bulk of enforcement authority from the court system to the Child Support Enforcement Agency of the Department of Human Resources (DHR). First, the Act amends several of Georgia's alimony and child support statutes. It removes the statute of limitations for foreign judgments of child or spousal support orders and provides that child or spousal support orders cannot be changed retroactively or become dormant. It makes late child support payments judgments by operation of law, sets a time limit for contempt hearings, and allows for …

Welfare "as we know it" ended in 1996, a victim of a conservatism that views welfare recipients as lazy and immoral. One aspect of welfare that is, however, unlikely to experience radical change is child support. More vigorous child support enforcement has become an increasingly important component of federal welfare reform bills over the past two decades because of the twin hopes of fiscal and parental responsibility: first, that child support will reimburse welfare costs, and second, that fathers will take more responsibility for their children. The problems inherent in interstate child and spousal support enforcement have been lamented for at least a half century. The federal and state governments have taken numerous steps to enhance interstate establishment and collection of support. Two of the latest steps in this process were the 1992 promulgation of the Uniform Interstate Family Support Act ("UIFSA") and the 1994 adoption of the federal Full Faith and Credit For Child Support Orders Act ("FFCCSOA"). The 1996 federal "welfare reform" bill' affected both of these statutes by requiring the states to pass UIFSA by January 1, 1998 and by amending FFCCSOA …
