Direct Inference In The Lost Chance Cases: Factfinding Constraints Under Minimal Fairness To Parties, Vern R. Walker

Hofstra Law Review

In this Article, I use the lost chance cases to examine the logical conditions for such a warranted direct inference in legal fact-finding. I first set out various interpretations of what "probable" means when used in the lost chance cases. This is the topic of part I. In part II, I use this discussion of the meaning of probability, together with an examination of two contemporary epistemological theories of direct inference, to propose an analysis of the appropriate conditions for the type of direct inference central to resolving the lost chance cases. This article evaluates the correctness of the decison in Geoffrey, Inc. v. South Carolina Tax Commission, 437 S.E.2d 13 (S.C.), cert. denied, 510 US 992 (1993), which held that the "physical presence" standard for determining state tax jurisdiction, as articulated in Quill Corp. v. North Dakota, 504 U.S. 298 (1992), does not apply in the context of a corporate income tax.

This Symposium on Television and Violence was developed as the first in a series to be offered under the auspices of the Joseph Kushner Distinguished Professorship in Civil Liberties Law, held by Professor Leon Friedman. We have gathered today to discuss television and violence because it is a topic of current interest, a new concern. Some of us are old enough to remember similar distress expressed in the 1950s, primarily by private persons rather than the government, over violence in comic books.
