Allocating The Burden Of Proof To Effectuate The Preservation And Federalism Goals Of The Coastal Zone Management Act, Martin J. Lalonde
Michigan Law Review
Primarily due to policy considerations, this Note argues that courts should allocate to the federal agency proposing an activity that may affect the coastal zone the burden of proving consistency with a state CMP. This allocation effectuates Congress's intent to vest states with primary control to preserve the coastal zone. Part I provides a general background of the Act's consistency requirement for federally conducted activities. Part II examines the various factors that courts traditionally consider when allocating burdens of proof in litigation. Part III evaluates these factors as applied to the consistency issue under the CZMA. Part IV concludes that …

A Primer On Public Land Law, Marla E. Mansfield

This article will examine the major missions and jurisdictions of the main federal land management systems, namely the public domain, the national forests, national parks, wildlife refuges, and wilderness areas. To introduce this examination, the constitutional provisions which justify the governing statutes will be explored. Additionally, as a prelude to the specific statutory mandates, this Article will review the system of reservations, withdrawals, and classifications. Preemption doctrine also will be addressed because states often desire to regulate activities on federal lands. Finally, the Article will distinguish between multiple use and dominant use.

From Conflict To Cooperation: Fishery Relations In The Sea Of Japan, Tsuneo Akaha

This article traces the postwar experiences of Japan, the most important fishing nation of the Japan Sea region, in establishing and expanding fishery relations with the Soviet Union/Russia, South Korea, and North Korea. The gradual shift from conflict to cooperation in the exploitation and management of fishery resources shows that pragmatic cooperation among the countries involved has been made possible by their willingness to accommodate mutual economic interests on an increasingly reciprocal basis. International law, particularly the U.N. Convention on the Law of the Sea, and the legal norms and principles it embodies have aided the parties in arriving at …

This article describes and analyzes the role of non-governmental organizations, or NGOs, in the system of governance that has developed to manage the use of natural resources, and that management's impact on the Great Lakes ecosystem. Particular emphasis is given to the organizational history of one such NGO, Great Lakes United, and its actions and strategies in relation to the Canada-U.S. Great Lakes Water Quality Agreements, and to the negotiations leading to the 1987 Protocol to the Agreements.
