Applicability Of Federal Antidiscrimination Legislation To The Selection Of A Law Partner, Michigan Law Review
Michigan Law Review
The decision by the members of a law partnership to invite an associate of the firm to become a partner involves careful consideration of the associate's qualifications. Recently some associates who have been denied advancement to partnership have alleged improper consideration of religion, national origin, or sex in the partner selection process. There are, of course, practical difficulties in proving discrimination in the subjective context of partnership selection. Assuming clear evidence of such discrimination, this Note addresses the question whether an associate may invoke the protection of federal antidiscrimination legislation.

Verdicts on Lawyers consists of twenty-three essays written by twenty-five authors,' most of them attorneys. The purpose of this compilation is to promote reform by (1) noting and describing deficiencies in the behavior of lawyers, in the structure and organization of the legal profession, and in rules and mechanisms that affect the distribution of legal services to poor and middle-class clienteles and (2) prescribing remedies for the problems noted.

Shaffer suggests a new paradigm for law practice that is not based on rigid control of clients in an impersonal attorney-client relationship. He argues forcefully that disregard for the client's emotions ignores important "facts" that can be used in the law office and the legal process. Shaffer's work suggests the possibility of gaining personal satisfaction and of providing more adequate legal services by actively counseling and understanding clients. Such a humanistic approach to the practice of law can be rooted only in an awareness of the psychological and social defenses erected against both the attorney's clients and the attorney's impact …

Using A Prediction Model In Forecasting Appeals, Paul A. Rake

Following the 1972 reorganization of the Indiana Court of Appeals into three panels serving defined geographical districts, the Court soon found itself floundering with too many unevenly distributed cases. Lacking a sufficient base of statistical data from which to formulate a plan to cope with the problem, various proposals, including redistricting the court, adding more judges, and developing a more sophisticated staff research, could not be measured for effectiveness or advisability.
In response to these problems, the Court developed a project to deal with the future caseload by constructing a regression model to predict appeals. This model generated estimates of …

Unequal Justice is a social history of the legal profession from the emergence of The American Bar Association in the 1870's until the 1970's. Auerbach is a professional historian and not a member of the legal profession who writes history, nor is he a sociologist. But before his graduate work in history, the author entered and quickly left law school. A great deal has been written during the past several years about the increasing number of professional liability actions that are being brought against attorneys by their former clients. Indeed, some commentators have taken the position that a legal malpractice "crisis", similar to the medical malpractice crisis that has so adversely affected physicians in recent years, is imminent for the bar. This short note will turn away from the factual question concerning the existence of such a crisis and look instead at the legal issues that form the basis of an attorney's professional liability exposure in Virginia.

The Data Base Components and Standards Committee of the Law Library Consortium recommends the establishment of a national law data base to meet the multi-faceted needs of the legal community for legal and law-related information. The scope of the Report includes bibliographic description and control, as well as subject and full-text access to Anglo-American, foreign, comparative, and international law materials in monographs, serials, non-book media including audio-visual and computerized information, computerassisted instruction, confidential data control and resource persons.
