In the last three decades, there has been a growing interest in correctional education programming and its effects on the recidivism rates of offenders. Research has concluded that programs such as general education equivalency (GED), college credit, and trade/vocational skill-building work to reduce recidivism rates among offenders. Who Are You Protecting?: A Feminist Analysis Of Gay And Trans Panic Defense Bans, How They Are Defined, And Who They Protect, Tyler S. Sesker

As of April 2022, sixteen U.S. states ban Gay panic and Trans panic criminal defenses. These state-law prohibitions stemmed from several high-profile murder trials, focusing on the identity of the decedent, including the killings of Matthew Shepard and Latisha King. Between 1970 and 2020, criminal defenses interrogating the gender identity or sexual identity of victims of violence were used at least 104 times, with nearly a third of those cases resulting in reduced criminal charges and penalties. Many Americans are pushing for legislation supporting increased gun control; however many critics argue that increasing gun control will limit Americans’ rights as defined in the Second Amendment. With Tennessee’s passing of the Constitutional Carry, the researcher found it relevant to build on past research and to evaluate East Tennessee State University students’ perceptions of current Tennessee gun legislation in the light of this new act. This thesis uses the 2016 sexual assault case The People vs. Brock Turner to argue that there is no clear path for justice for sexual violence in the current criminal justice system while incarceration remains the primary form of punishment. I draw on court documents and the victim Chanel Miller's 2019 memoir Know My Name to inform my analysis.

This thesis project examines the similarities in structure, initiation processes, af liations, and motivations for joining both criminal street gangs and fraternities. These similarities serve as the foundation for the central idea of the thesis: using California’s street gang legislation, mainly the S.T.E.P. Act, to more severely prosecute fraternities for their crimes. My application of the legislation is supported through both comprehensive gang data, as well as case studies of fraternity crimes, as comprehensive data for this group does not exist.
