When Can The Baseball Writers For The Hall Of Fame Consider Cheating Through Ped Use, Or Not?, Wes R. Porter, Dan Dressman

When the 2013 MLB Hall of Fame Ballot was released this past November, the heated discussion began about which controversial candidates, if any at all, would be inducted into Cooperstown (HOF). while isolated athletes have come up in previous years, this year represents a first real tension between the modern ear of baseball - the "steroid era" - and traditional standards for admission into the Hall. The 537 baseball writers are, and should be, entrusted to weigh cheating and use of PEDs against the HOF's criteria of "character," "sportsmanship" and "upholding the integrity of the game." Interpretation And Construction In Altering Rules, Gregory Klass

This essay is a response to Ian Ayres's, "Regulating Opt-Out: An Economic Theory of Altering Rules," 121 Yale L.J. 2032 (2012). Ayres identifies an important question: How does the law decide when parties have opted-out of a contractual default? Unfortunately, his article tells only half of the story about such altering rules. Ayres cares about rules designed to instruct parties on how to get the terms that they want. By focusing on such rules he ignores altering rules designed instead to interpret the nonlegal meaning of the parties' acts or agreement. Eighty-four percent of immigrants appearing before immigration judges are unrepresented. Immigration judges are overwhelmed with the dual role of adjudicating cases and serving as counsel to pro se individuals appearing before them. In addition, due to the rising costs of retaining a lawyer, immigrants are turning to immigrant consultants. These incompetent and unscrupulous individuals are preying on vulnerable immigrants and engaging in the unauthorized practice of law. In addressing unmet legal needs for immigrants, most advocacy efforts for immigrants regarding the acquisition of competent representation focus on persuading the courts that immigrants appearing before an immigration judge have a constitutional …

Homicide In The Brazilian Favela: Does Opportunity Make The Killer?, Elenice De Souza De Souza Oliveira, Joel Miller

Department of Justice Studies Faculty Scholarship and Creative Works

High rates of homicide in Brazil are heavily concentrated in poor urban shanty towns or ‘favelas’. This paper looks beyond conventional social and economic explanations of homicides, and examines the relationship between situational factors and homicide incidents within a case-study favela in the city of Belo Horizonte. Initial exploratory research identified potential mechanisms linking local situational characteristics with homicide. A matched case–control study then tested hypotheses based on these mechanisms. When the characteristics of 100 addresses of homicide incidents were compared with those of 100 nearby non-homicide addresses, they showed statistical associations with drug areas, bars, alleys, windows onto the …

Governor Edmund G. Brown created the Interagency Council on Veterans (ICV) to improve how veterans’ services are coordinated across local, state and federal governments. To that end, the California Department of Veterans Affairs (CalVet) brought together governmental organizations in December 2011 and nongovernmental organizations in January 2012 to help CalVet do some preliminary planning for the ICV. In February 2012, CalVet Secretary Peter Gravett and Labor and Workforce Development Secretary Marty Morgenstern convened the inaugural conference of the ICV to discuss – among other topics – veterans’ service needs, gaps in veterans’ services, and obstacles to meeting veterans’ needs, as …

The Coalition Government is currently considering how to transpose Directive 2010/63/EU on animal experimentation into UK law. The Directive bans the use of Great Apes in laboratories, but EU Member States can seek (now or, more likely, at some time in the future) a derogation from the Commission to permit such use, where this is considered essential for the preservation of the species in question or in relation to an unexpected outbreak of a life-threatening or debilitating clinical condition in human beings.
