Informal Deference: A Historical, Empirical, And Normative Analysis Of Patent Claim Construction , J. Jonas Anderson, Peter S. Menell

The Federal Circuit has been the target of a flurry of criticism regarding its claim construction jurisprudence. District judges, members of the bar, academics, and even the court's own judges have been highly critical of the court's rate of reversal of claim construction appeals, which peaked above 40%. Partially in response to the critics, the Federal Circuit undertook to reassess its claim construction jurisprudence in the Phillips case in 2005. The empirical and theoretical studies that have emerged since Phillips suggest that little has changed: the Federal Circuit's high reversal rate persists and the court's procedures remain unaltered. The crisis of solid waste disposal has only recently been addressed by government agencies, most successfully at the state and municipal levels. Although new laws cover the disposal of waste, few affect the causes or reduction of wastes. Economic incentives that underlie waste management must be examined to ultimately reduce the waste stream. Policy options that incorporate these incentives are evaluated, with the most effective policy defined as one in which efficiency gains are greater than the transaction costs of enacting a new waste policy. Such policies might include the use of taxes, tip charges, and adjustments of prices to …

The author expresses opinion on an essay by professor Richard Epstein on intellectual property and property rights movement. He says the professor acknowledges that governance of intellectual property involves a complex public policy balance that varies from real property governance. He stresses Epstein should agree that the uniform structure of patent law across all innovation may be a significant issue. From its earliest manifestations, copyright law has struggled to deal with the equitable and efficient division of value and control between creators and the enterprises that distribute their works. And for almost as long as copyright has existed, there has been concern about creators getting the short end of the stick in their dealings with distributors. Since 1909, Congress has sought to protect authors and their families by allowing them to grant their copyrights for exploitation and then, decades later, to recapture those same rights.
