The paper examines the requirements of each section of Illinois Code of Civil Procedure Section 2-619(a) in greater depth by examining appellate and Illinois Supreme Court rulings in cases brought under each section of 2-619(a). It also analyzes the standards of review appellate courts apply under each section of 2-619(a). Finally, because 619(a) motions require affidavits in support of the motion, it is also necessary to consider the nature and sufficiency of affidavits.

Distinguished jurist and scholar, Judge Richard Posner of the U.S. Court of Appeals for the Seventh Circuit penned a concurrence in United States v. Boyce, 742 F.3d 792 (7th Cir. 2014), in which he launched a scathing attack on the scheme of categorical hearsay exceptions embodied in the Federal Rules of Evidence. After characterizing the existing hearsay regime as bad “folk psychology,” Judge Posner called for the repeal of categorical hearsay exceptions in favor of case-by-case determinations about the “reliability” of particular hearsay statements by trial judges. This article discusses the modern convergence of three traditionally separate topics: globalization and international human rights on the one hand, and civil procedure on the other. Its project is twofold: first, to highlight the role of domestic legal processes and communities in the advancement of the post-World War I1 international human rights project. El autor nos ofrece su punto de vista sobre el tema en discusión del VII Pleno Casatorio desde la óptica de las normas procesales. Expresa su posición en favor de la propiedad no inscrita, siempre que ella estuviera reconocida en documento de fecha cierta anterior al embargo trabado y registrado. Afirma que nuestro ordenamiento procesal busca defender un hecho insoslayable: no es posible afectar con un embargo y obtener una cobranza, con un bien que no es de propiedad del deudor.

En este artículo se analiza de manera crítica el proceso único de ejecución de desalojo comprendido en el Decreto Legislativo N.º 1177, aplicable a las modalidades contractuales reglamentadas por esta norma: arrendamiento de inmueble destinado a vivienda (arrendamiento tradicional), arrendamiento de inmueble destinado a vivienda con opción de compra, y arrendamiento financiero (leasing) de inmueble destinado a vivienda. Como lo hace ver el autor, destacan como particularidades (novedades) de la nueva regulación la posibilidad de demandar el desalojo por terminación del contrato siempre que se dejen de pagar dos (02) meses consecutivos (supuesto distinto del contemplado en el Código Civil) …

Una correcta definición de poseedor precario pasa por establecer una noción, lo más exacta posible, del ‘título’ a que se refiere el artículo 911 del Código Civil. States' and nations' laws collide when foreign factors appear in a lawsuit. Nonresident litigants, incidents outside the forum, and judgments from other jurisdictions can create problems with personal jurisdiction, choice of law, and the recognition of foreign judgments. This Article reviews Texas conflict cases from Texas state and federal courts during the Survey-period from November 1, 2011 through October 31, 2013. The Article excludes cases involving federal-state conflicts; intrastate issues, such as subject matter jurisdiction and venue; and conflicts in time, such as the applicability of prior or subsequent law within a state. State and federal cases are discussed together …

A partir de uma interpretação da segurança jurídica como uma forma de capital, o capital jurídico, explora-se as consequências sociais da ausência de mecanismos de coordenação entre magistrados para a formação e manutenção de jurisprudência, em especial, o anarquismo judicial. Utilizando-se um modelo agente-principal, demonstra-se que os magistrados brasileiros não possuem incentivos e mecanismos suficientes para investir em capital jurídico e uniformizar regras jurídicas. A insegurança jurídica resultante gera incentivos para a sobreutilização dos tribunais, resultando no problema endêmico de congestionamento.
