Chambers V. District Of Columbia And The Future Of Title Vii, Andrew Melzer, Alok Nadig, Lindsay Marum

Can blatant workplace discrimination escape the grasp of Title VII? In Chambers v. District of Columbia, the D.C. Circuit is considering whether to revisit a rule that employment discrimination must result in “objectively tangible harm” to give rise to a Title VII claim. In this article, the authors argue that the D.C. Circuit should stay true to the language and purpose of Title VII and adopt a standard similar to the simple “treated less well” test used under the NYC Human Rights Law.

Background: Organizational change, primarily in institutional settings, is necessary to prevent institutionalization as well as to reach the goals of the organizations. To support these goals, institutional settings, such as correctional facilities, often use restrictive measures including occupational deprivation. As a profession, occupational therapy recognizes the importance of occupational participation for all persons in society, however there is a gap in knowledge on the importance of how to promote and/or educate other entities on successful change management in different institutional settings.

One of the most vulnerable and growing populations within the United States (U.S.) are youth involved in the juvenile justice system. Each day, approximately 60,000 youth are currently incarcerated in the U.S., signifying a necessary demand for community re-entry success. Having been incarcerated makes it more challenging for youth to attend school, obtain a license, find public housing, and attain public benefits. Furthermore, because of the effects following being a part of the juvenile justice system, the youth exemplify a lack of social interaction skills, hindered relationship patterns, altered values and beliefs. The George B. Hugo Correspondence consists of his book Socialism: The Creed of Despair and 25 letters related to its publication.

George B. Hugo was born in 1866 in Massachusetts to French immigrants. Hugo married Jennie Saulsbury in 1888 in Boston and in 1893 a daughter they named Ruth was born. In Boston, Massachusetts, George worked as a merchant. In 1909 he published his book, Socialism: The Creed of Despair. This paper interrogates the very form of collective decision making that legislation signifies, its operationalisation in adjudication, and its interrelation with popular culture. Through the lens of the Egyptian legal system, the paper offers case-studies of collective decision making on matters of personal status, it focuses on the state's different approach towards the regulation of personal status for its Muslim and non-Muslim citizens; in the legal context of the ‘best interests of the child’ it looks at the multiple entanglements of legislation and its eventual actualisation in Egyptian courts; and it uses classical examples of Egyptian cinema popularly associated with …

“Under The Guise Of Public Health:” The Biden Administration And Title 42, Casey Plach

In March 2020, the Trump Administration set forth a policy, now known as Title 42, which closed U.S. borders and allows government officials to immediately expel migrants—including asylum seekers—citing public health concerns in light of the COVID-19 pandemic. Still in effect today, Title 42 has faced criticism from legal experts and health experts alike, who claim the policy directly conflicts with asylum laws and has little basis in public health. In this article, Casey Plach explores this criticism and critiques the Biden Administration’s continued use of Title 42.

ERISA fiduciaries have long sought guidance from the DOL as to whether environmental, social, and governance (ESG) factors may be considered in their investment decision-making. In 2020, the DOL issued a final rule requiring ERISA fiduciaries to consider solely pecuniary factors. In this article, Morgan Fox discusses a recently proposed rule under the new Administration that eases the restrictions and provides greater leeway for ERISA plan fiduciaries to consider ESG factors.
