BUT DID THEY LISTEN? Instructed by the state legislature to consider all aspects of the death penalty, invited to propose appropriate legislation, the New Jersey Death Penalty Study Commission’s final report nearly unanimously urges abolition with life without parole as a substitute. Apparently unbiased in its approach and thorough in its deliberation, the Commission’s final report distorts the evidence, shows a consistent anti-retributive bias, and worst of all, ignores basic well-established perspectives framing the great debate.

BUT DID THEY LISTEN? Based upon the Death Penalty Study Commission’s near unanimous final report, New Jersey stands poised to become the first state during the modern era to legislatively abolish the death penalty. Hailed nationally and internationally as a model, apparently unbiased and thorough, the Commission’s final report distorts the evidence and worst of all, ignores basic well-established perspectives framing the great debate. This essay takes on the Report’s anti-retributive bias, and provides an alternative point of view that ought to counter a rush to judgment and spur legislators in other states more seriously to reconsider life (without parole) …
