Although you can find it just about everywhere, the twenty-first century supermarket is hard to define. Consumers have no need to define them They tend to visit these huge and efficient emporia weekly or more often, and they know they can buy what they need there. That's all they need to know. Transactional lawyers who specialize in lease negotiations can't think of the supermarket solely as a place where they can buy food and other things. Professional Discipline Of Prosecutors: A Response To Professor Zacharias, Monroe H. Freedman

In a recent article, The Professional Discipline of Prosecutors, Professor Fred C. Zacharias reports the results of an empirical study he has conducted of disciplinary actions against prosecutors. Based on a computer search of reported cases, he concludes that there is an "overall trend of infrequent [disciplinary] prosecutions," suggesting "neglect or sloth" on the part of the authorities, and he properly calls for more effective use of professional discipline of prosecutors.

By way of preface to this Symposium, I offer an account of the ordeal of Earl Washington, who-having come within days of execution-was released from prison on February 12, 2001, after DNA evidence of his innocence finally proved conclusive to the Virginia authorities. I do so for two reasons.

First, I believe, both as a member of his legal team and a scholar, that history deserves an accurate account of the events. Second, more broadly, I believe that the case exemplifies many of the phenomena that contribute to the injustice of the death penalty in America today, and that its …

Corporate Defense Law For Dispersed Ownership, Nicholas L. Georgakopoulos

The Delaware law regarding defensive tactics has a consistent and unnoticed undercurrent: it favors defenses against attacks that would concentrate corporate ownership. Similar trends seem to be developing in European merger and acquisition law, but they have a different flavor. Europe tries to foster dispersed ownership by discouraging defenses because it starts from an environment of concentrated ownership. Professor Georgakopoulos argues that pursuit of dispersed ownership is justified from an economic perspective and that defenses are intimately related with dispersed ownership.
