Property Commercial Real Estate Broker Lien Act: Provide For Civil Actions To Enforce Liens Of Commercial Real Estate Brokers, Glenn D. Baker

The Act authorizes commercial real estate brokers to execute liens on commercial real estate arising out of a listing or any other agreement for the management, sale, or lease of commercial real estate. The Act permits real estate brokers to commence civil actions to enforce such liens and provides for the attachment of liens, the recording of claims for the liens, and the method for providing notice of the liens. The Act provides for escrow accounts in connection with claims for liens, for pleadings relating to these matters, and for release or extinguishment of such liens.

The Act provides that owners or contractors of real property must provide written notice of the identities of the property owner, the contractor, and any surety or construction lender for a construction project to persons who are not in privity of contract with the project contractor and who provide labor, services, or materials for the improvement of the property. Such written notice must also be filed with the clerk of the superior court of the county in which the project is located. The Act makes extensive changes in the manner in which a pawnbroker may offer loans to individuals who pledge the title of their motor vehicle as security. The most significant provisions of the Act set new limits on the amount of interest which may be charged on a pawnbroker loan and require pawnbrokers to provide individuals seeking such loans with detailed disclosure settlements. The Act further revises the Georgia Code sections dealing with the leasing of motor vehicles pledged for loans, limitations on the duration of pawn transactions, the amount of storage fees which a pawnbroker may charge, the amount …

The Act makes null, void, and unenforceable any waiver of a right to claim a lien in advance of furnishing labor, services, or materials. Further, any lien waiver executed after commencement of a project, whether to induce a progress payment or final payment, must substantially follow the forms set forth in the Act. Within thirty days after entering into a lien waiver conditional on payment, an unpaid contractor must file an Affidavit of Nonpayment or else such amounts owed shall be deemed paid in full and the condition of payment satisfied.

The Act declares that certain items are contraband, and that no property rights exist as to those items. The Act provides for the seizure of property subject to forfeiture and for the filing of a lien for forfeiture upon the initiation of any civil or criminal proceeding under this article, as well as upon seizure.
