Georgia law previously allowed counties and municipalities to permit the sale of alcoholic beverages on Sundays from 12:30 P.M. until 11:30 P.M. This Act, deemed “the Brunch Bill,” authorizes the counties and municipalities that have affirmatively voted by referendum to sell alcoholic beverages on Sundays to sell them earlier, at 11:00 A.M., if approved by a second referendum vote. This change applies to restaurants that make at least 50% of their revenue from the sale of food and hotels, and Georgia wineries.

The Act permits individuals to transport limited quantities of alcoholic beverages purchased outside of Georgia that are for personal or household use and for which the state excise tax has been paid. The Act requires that individuals transporting alcoholic beverages in excess of the amount exempted from payment of excise taxes must have proof of payment of the excise taxes. The Act provides for special order shipping licenses that exempt holders from general licensing requirements when transporting limited quantities of wine directly to consumers for personal or household use. The Act amends Code section 3-3-20 to permit the sale of alcoholic beverages on election day in counties and municipalities that allow sale of alcoholic beverages. The Act also authorizes counties and municipalities to prohibit the sale of alcoholic beverages on election day.

Courts Punitive Damages: Provide For Lifting The Cap On Punitive Damages For Torts Committed While Tortfeasors Are Under The Influence Of Drugs, Jeremy Emanuel Citron

The Act provides that a plaintiff, suing for a tort committed while the tortfeasor was under the influence of alcohol, drugs, or an intentionally taken substance that had the effect of impairing the person, can be compensated with punitive damages awarded against the tortfeasor. The Act does not require that such a tortfeasor display any intent to do harm or be acting in a malicious or aggravated manner. The Act does not limit the amount of punitive damages that may be awarded against the tortfeasor.

The package of bills makes it unlawful for any person to possess an open container of an alcoholic beverage while operating a motor vehicle. The level of alcohol concentration that constitutes driving under the influence is reduced to 0.10 grams, with a level of 0.06 grams for minors under the age of eighteen. The package provides for the publication of the name, address, and photograph of any person convicted a third time of driving under the influence of alcohol or drugs.
