The Arbitral Award In The Matter Of The South China Sea Between The Philippines And China What Are The Implications For Freedom Of Navigation And The Use Of Force?, Cameron Moore

This article considers the implications of the Award for freedom of navigation and the use of force in the South China Sea, identifying the conclusions that can be drawn from the Award and the questions that remain. The Award also indirectly raised the question of the use of force to defend navigational rights. This article therefore revisits the Corfu Channel Case for the light it may shed on the use of force and freedom of navigation in the South China Sea. The plight of the southern Philippines is a lesson in how not to undertake a peace process. It especially illuminates the pitfalls of negotiating without the wholehearted commitment of the stakeholders, especially the central government. Successive regimes in Manila have made feints at achieving a settlement in Mindanao, but the national leadership has been in turns half-hearted, dilatory and insincere. So the south remains in turmoil despite the best intentions and unflagging efforts of peace advocates. The welcome extended to him was amazing - at least six million people attended an open-air mass in Metro Manila after large crowds greeted him inTacloban, the typhoon-ravaged city which was virtually destroyed at the end of 2013.

This book grew out of three intensive workshops and a great deal of collective brainstorming. The hard work has been worthwhile. As edited compilations go, this is a valuable collection that provides a number of insights into the occupation by the US of the Philippines from the beginning of the twentieth century and of Japan after the Pacific War. The project as a whole bears out the value of a collective enterprise that is planned and executed carefully and with a commonality of purpose. Many of the ideas that emerge from the shared focus are illuminating.
