When a city or town in West Virginia desires to annex additional territory, it is frequently faced with perplexing problems in determining just what the proper procedures are. In some instances it is almost impossible to say with certainty whether certain annexation provisions of the code are applicable for a proposed annexation. One of the major problems is that the annexaton provisions of West Virginia's code are found in two separate chapters, chapter 8 and chapter 8A. The requirements for annexing additional territory are quite different in each of the two chapters. The purpose of this note is to examine …

In his pivotal primary victory over Hubert Humphrey, President John F. Kennedy pledged that he would lend vigorous assistance to the impoverished coal mining regions of West Virginia to alleviate their economic distress. In fulfillment of this pledge, Congress passed and President Kennedy signed into law in May, 1961, the Area Redevelopment Act in order to "establish an effective program to alleviate conditions of substantial and persistent unemployment and underemployment in certain economically distressed areas." The Area Redevelopment Act created an experimental pilot program within the Department of Commerce to accomplish the above purpose through a system of government loans …

An understanding of the rights and powers of the various parties involved in a Chapter XIII proceeding is not easily had. The statutory language is somewhat windblown, sometimes confused and frequently ambiguous. Reported decisions in Chapter XIII cases are few. However, Chapter XI, dealing with arrangements, and Chapter XIII, dealing with wage earner plans, contain many identical or quite similar provisions, so that an interpretation of one of the chapters often has significance as authority for a like position under the other chapter. Where such is the case, reference will be made to cases decided under or a treatise on …
