Sovereignty And Cooperative Management Of Shared Water Resources In A Time Of Shrinking Availability: The Role Of International Law, Stephen C. Mccaffrey

It is a commonplace today that per capita availability of fresh water is shrinking. In addition, it is well known that some 60 per cent of global freshwater flows are contained in the 263 river basins that are shared by two or more countries, and that around 40 per cent of the human population lives in these international basins. These facts underscore the necessity of cooperation between states sharing fresh water, whether it is on the surface or underground. And yet internal political forces often lead countries to maximize their use of shared water resources without considering adequately the needs …

A critical part of any country’s development is its legal infrastructure. The proper functioning of civil and commercial society depends upon the existence of a reliable system of law administered by dependable courts. Foreign and domestic businesses want some assurance that commercial disputes will be settled in accord with the law and the facts, and neither can thrive without some protection of fundamental human rights. Tourists and expatriates are also reluctant to visit countries that do not provide reliable legal protections. All this we commonly refer to as the rule of law. Defining The Reasonable Person In The Criminal Law: Fighting The Lernaean Hydra, Michael Vitiello

When courts invoke the reasonable person as a means to assess culpability, they attribute to the standard some but not all of the objective and subjective characteristics of the accused. The Model Penal Code provides little guidance because the drafters intentionally punted on the issue, leaving line-drawing to the courts. This Article examines four classic self-defense cases and concludes that the courts have not drawn consistent lines regarding exactly which characteristics should be imparted to the reasonable person. The Article examines the most prominent areas of deviation and observes that fundamental inconsistencies within our societal notions of fault and punishment …

Bush, Obama And Beyond: Observations On The Prospect For Fact Checking Executive Department Threat Claims Before The Use Of Force, Leslie Gielow Jacobs

This piece looks at the recurring problem of inflated threat claims offered by executive branch actors to persuade the Nation to consent to the use of force. It sets out the experience of the Bush Administration’s use of incorrect threat claims to persuade the country to consent to the use of force in Iraq as a backdrop to evaluating the President Obama’s use of threat claims to support the continuing use of force in Afghanistan. Although comparison of threat advocacy by the Bush and Obama administrations must be imperfect, it allows for some observations about the extent to which the …
