The issue of rape continues to be of concern in the United States. Rape is defined as any unwanted or forcible penetration without consent (United States Department of Justice, 2017). More specifically, rape can include sexual violence tactics such as force, threats, manipulation, or coercion (National Sexual Violence Resource Center, 2022). The magnitude of the issue of rape has been demonstrated, with adult rape data showing that on average, 319,950 people over the age of 12 were raped or sexually assaulted in the United States annually in 2020 (Morgan, 2021). Shared custody has traditionally been looked upon with disfavor by the courts. Similarly, some professionals in the field of child development oppose the concept of shared custody. There are, however, several advantages to shared custody. The legal system benefits, as judges escape the unenviable task of playing Solomon. The problems of character evidence "resolved" by the new Federal Rules are problems that involve the structure of human personality. The judgmental processing by jurors of character information involves a behavioral transaction called interpersonal perception. Each of these psychological problems has been intensively investigated for nearly 40 years. As the character problems of the law now take on the appearance of having been solved, there is not the slightest indication that the results of this scientific endeavor influenced the choices made by the law.
