The Attorney General of Texas is the only elected official charged with regulating the state’s charitable interest. This duty and authority over charitable assets and entities are comprehensive and unique in themselves. Although the broader state representation role of American attorneys general has evolved considerably and been substantively codified in the statutory law, the area of charity regulations has remained remarkably true to its common law root. Fair Labor Standards Act And Sovereign Immunity: Unlocking The Courthouse Door For Texas State Employees., Melinda Herrera

Unless Texas expressly waives its Eleventh Amendment sovereign immunity, its state employees will not have similar legal recourse and protection as those available to private employees. As in many other states, a party may not sue the State of Texas without its consent. Thus, in the absence of constitutional or statutory provisions to the contrary, a state may claim sovereign immunity against any suit brought by a private party in both federal and state court. Soft virtues, normally associated with women, have been deemed to have no legal, market or public value, and this has caused problems within American society. The devaluation of cooperative and nurturing virtues, coupled with the dangerous myth of independence and self-reliance, and general acceptance of consumption as a positive attribute, have had a profound effect on American society as a whole and, in particular, on general views on the care of children and other dependent members of our society.
