Lawyers should be much more concerned with the concepts of truth and evidence. The entire profession depends on truth. It is what police detectives, District Attorneys, juries, trial judges, appellate judges, and academic lawyers offering interpretive theories, are all concerned with. But, since truth is seldom apparent on its sleeve, these legal actors are equally dependent on evidence as the only(?) reliable(?) means of determining truth. The article argues that a plausible normative justification of law and government can be constructed along the lines of the ancient natural law tradition. Rather than assuming the God of western theism, however, the article endorses a biologically based, and thoroughly secular, metaphysical basis for natural law.

Deeply and widely held political and moral values, as well as contemporary constitutional principles, demand that we look more thoroughly at our commitment to equality, liberty, and the pursuit of happiness. Such an examination, I argue, makes it close to self-evident that homosexual couples should have the right to full legal marriage.

The article defends an analysis of privacy as those areas of a person’s life where s/he is entitled to immunity from the illegitimate focused attention of others. It goes on to argue that such a model encompasses the concept of privacy in colloquial and legal contexts. The article concludes with an analysis of the normative value of privacy.
