Mapping The Outcomes Of Multidisciplinary Intellectual Property Research: Lessons From The African Copyright Experience, Jeremy De Beer

Multidisciplinary intellectual property research often involves large-scale collaborative projects. Such projects combine not just multiple research frameworks, methods, and perspectives, but also multiple individuals, institutions, and sources of funding. Demonstrating the results of financial and human resource investments into complex multi- disciplinary projects is increasingly important. Experiences from one recent multidisciplinary project — the African Copyright and Access to Knowledge project — provide lessons for other intellectual property researchers trying to map outcomes from current and future projects.

This article applies the Max Planck Principles on Intellectual Property Provisions in Bilateral and Regional Agreements to several recently established or still-being-negotiated international lawmaking instruments. It identifies recent, fundamental changes and overarching patterns in the evolution in the procedures, institutions, and substantive outcomes of international intellectual property law- making. This article examines the negotiations towards a Comprehensive Economic and Trade Agreement (CETA) between Canada and the European Union (EU) as an example of some challenges and solutions for implementing international trade agreements in multilevel federal systems. It briefly describes Canadian constitutional law governing the domestic implementation of international treaties and then canvasses three specific examples of current challenges related to the regulation of intellectual property. The African Copyright and Access to Knowledge (ACA2K) project is a pan-African research network of academics and researchers from law, economics and the information sciences, spanning Egypt, Ghana, Kenya, Morocco, Mozambique, Senegal, South Africa and Uganda. As the sciences of biotechnology, synthetic biology and nanotechnology develop, questions about liability for harms caused by self-replicating inventions will arise increasingly often. Although negligence, nuisance and other torts may be relevant in such cirumstances, trespass may be the more appropriate cause of action. In the first section of this paper, I explore doctrinal hurdles facing plaintiffs alleging biotrespass. To overcome concerns about the meta-physicality of molecular biotrespass, I draw analogies to "cybertrespass." To confront the problem of suing patent licensors for the actions of their licensees, I make reference to principles of landlord-tenant law. Well-established laws concerning wandering animals …

Rights & Responsibilities Of Biotech Patent Owers, Jeremy Debeer

In this article, I identify a legal disequilibrium in Canadian IP law. Recent decisions in Schmeiser and Hoffman illustrate a trend away from accountability for technological innovation and toward according technological innovators more numerous and powerful property rights. I show how this is a result of a failure by the Court to consider biotechnology issues as part of a bigger picture. By looking at these issues though the lens of patent law or tort law in isolation, Canadian courts have held that a patent entitles its owner to all of the rights but none of the responsibilities of ownership.
