The Integrity Of The Arbitral Process, Roger Abrams

This article addresses the fundamental issues of procedural fairness that must be considered in evaluating the labor arbitration process. The Supreme Court has given that process significant autonomy, even to decide disputes that may also constitute statutory violations. What then is the role of a court in these cases? The Supreme Court suggested that a court should give respect to arbitral awards if the process employed was fundamentally fair. This article articulates the elements needed within the labor arbitration process in order to meet the Court’s test.

Beyond The New Federalism: Revenue Sharing In Perspective, George D. Brown

In 1972 Congress added General Revenue Sharing to the list of federal grant-in-aid programs for states and localities. President Nixon had recommended Revenue Sharing, as apart of his "New Federalism," because it would foster local autonomy by minimizing federal restrictions on the grants. When General Revenue Sharing was renewed in 1976, Congress made no changes in the formula, leading some commentators to minimize the significance of those changes which were made. The 1960's marked a watershed for the criminal justice system. In such areas as search and seizure, right to counsel and the privilege against self-incrimination, the federal courts first defined substantive constitutional rights and then imposed them upon disinclined functionaries at the state level. At first, these innovations raised thorny questions of constitutional interpretation about the rights involved, but, as is especially visible in the search and seizure area, the debate more recently has focused on the remedy chosen by the Supreme Court for enforcing these rights against the states.'
