Unlocking The Potential Of Private-School Choice: Avoiding And Overcoming Obstacles To Successful Implementation, Nicole Stelle Garnett
Unlocking The Potential Of Private-School Choice: Avoiding And Overcoming Obstacles To Successful Implementation, Nicole Stelle Garnett
Books
The parental-choice movement has secured a number of important victories in recent years. There are now 65 private-school-choice programs in the U.S., serving approximately 700,000 students, including new universal education savings account programs in Arizona, Arkansas, Iowa, Utah, and West Virginia. Despite this progress, however, existing private-school-choice programs have, in some ways, fallen short of their transformational potential. The number of students served remains stagnant and below capacity in many states, faith-based (and especially Catholic) schools continue to close despite new eligibility for public funds, most funds are used to fill seats in existing schools and rather than driving the …
Catholic Social Teaching: A Volume Of Scholarly Essays, Gerard V. Bradley
Catholic Social Teaching: A Volume Of Scholarly Essays, Gerard V. Bradley
Books
Gerard V. Bradley and E. Christian Brugger eds.Catholic social teaching (CST) refers to the corpus of authoritative ecclesiastical teaching, usually in the form of papal encyclicals, on social matters, beginning with Pope Leo XIII's Rerum Novarum (1891) and running through Pope Francis. CST is not a social science and its texts are not pragmatic primers for social activists. It is a normative exercise of Church teaching, a kind of comprehensive applied - although far from systematic - social moral theology. This volume is a scholarly engagement with this 130-year-old documentary tradition. Its twenty-three essays aim to provide a constructive, …

Lloyd Hitoshi Mayer, Creating a Tax Space for Social Enterprise, in The Cambridge Handbook of Social Enterprise Law 157 (Benjamin Means & Joseph W. Yockey eds., 2018)
While still relatively few in number compared to traditional nonprofit and for-profit organizations, the rise of social enterprises represents a possible disruption of not only existing models of doing business but also areas of law that in many respects have seen little fundamental change for decades. One such area is domestic tax law, where social enterprises currently find themselves subject to the rules of for-profit activities and entities. Here, both scholars …

A familiar problem to scholars of fiduciary law is that of definition. Fiduciary law has been called “messy,” “elusive,” and “unusually vexing.” In part, this is because fiduciary law principles appear in many areas of law, but are applied differently in each. This has made the development of a unified theory difficult. Some scholars have doubted …

Congress & Sports Agents: A Legislative History Of The Sports Agent Responsibility And Trust Act, Edmund P. Edmonds, William H. Manz, Thomas J. Kettleson.
Books
Although a majority of individual states have adopted legislation directed toward the conduct of sports agents, the federal government found it necessary to enact Public Law 108-304, the Sports Agent Responsibility and Trust Act (SPARTA). Congress has recognized that many acts of sports agents go unpunished because of disparate, ineffective, or in some cases, a complete absence of state laws.
This volume offers readers the legislative history of SPARTA, including copies of the law, reports, hearings, and related bills. An additional feature of the set is an appendix containing state legislation in this area. The appendix includes the language from …

Migrant workers face special problems in terms of qualifying for, and receiving payment under, national social security systems. In an effort to mitigate these problems, many states coordinate their social security systems. This paper explores how coordination schemes work in regional mechanisms such as the European Union, in international conventions adopted by the International Labour Organisation, and in multi-lateral treaties such as the Andean Social Security Instrument.
