This article discusses a California case rejecting a guarantor’s claim of equitable contribution from co-guarantors because they were not at the same level of liability, and also rejecting a subrogation claim because it could be used only against the primary debtor, not other secondary debtors.

This article discusses the unpredictability of determining whether the rules of offset or the rules of priorities will prevail in a situation, and goes into the question of whether attorneys’ fees will be given priority over other claims when those fees are contractual and do not relate back. The article concerns a California decision which held that a lis pendens did not give purchasers superpriority over competing liens.

This article reviews conflicting appellate court decisions where landlords were sued in tort under state statutes that all imposed the same general duty to take care of the property but failed to address what happens when personal injuries follow.

Ninety Years Of Health Insurance Reform Efforts In California, California Research Bureau

This report will provide an overview of legislative and gubernatorial efforts to increase the number of Californians with health insurance. It will review the state's health care policy for the medically indigent for the period from 1918 until the present, and will describe legislative proposals to increase the number of insured. The review will also indicate whether the proposals were financed by regressive or progressive revenue taxes, fees, or insurance premiums. Over that period, legislators introduced at least 44 measures to reduce the number of medically uninsured people in California. There also were four ballot measures that would have increased …

The Educational Success Of Homeless Youth In California: Challenges And Solutions, California Research Bureau

The California Research Bureau (CRB), in participation with the California Council on Youth Relations (CCYR), and with support from The California Wellness Foundation, has been conducting a major research and policy initiative to bring attention to the issues facing homeless youth in California. These include lack of shelter and educational opportunities, health and mental health needs, and problematic interaction with law enforcement agencies and the courts.

A Brief On Biosolids: Options For Biosolids Management, California Research Bureau

Biosolids are municipal sewage treated to meet federal and state standards required for land application. This paper describes the production and management of biosolids in California; the regulatory framework that controls the use and disposal of biosolids; and, the controversy surrounding their use as a soil amendment and alternatives to the current management practices for biosolids with emphasis on their potential use as a source of energy.

The Bar Examiners got rather lazy in their Property question on the last bar exam. Instead of asking a reasonably complex or difficult essay question, they took four little multiple choice hypotheticals and packaged them into one large but utterly unintegrated question, with no connection of any kind between the parts.

In the United States, the environmental justice movement began with a focus on the inequitable burden of toxic exposures placed on low-income minority residents. There is now an increasing recognition that low-income minority residents also often face inequitable access to environmental amenities such as open space, parks and wilderness. Access to Parkland: Environmental Justice at East Bay Parks examines questions of equity for low-income minority residents related to the parkland holdings of the East Bay Regional Park District, the agency that manages close to 100,000 park acres in Alameda and Contra Costa counties east of San Francisco Bay.
