On August 14, 2020, the Clinic filed a brief with the Third Appellate District in the Court of Appeal in the State of California, arguing that claims alleging that the State water board violated its own regulations in issuing permits governing are actionable under state law. On behalf of several grassroots community groups, the Environmental Law and Justice Clinic at Golden Gate University School of Law issues this report to publicize the Bay Area Air Quality Management District’s permitting and enforcement practices that insufficiently protect the public against harmful air pollution, including particulate matter (PM) and toxic air contaminants.

This report discusses the results of an investigation into concrete manufacturers in the San Francisco Bay Area, the Bay Area Air Quality Management District’s (BAAQMD) handling of the concrete plants’ air pollution violations and the agency’s failure to follow its own enforcement guidelines.
The investigation focused on three concrete manufacturers operating in the City of San Francisco and around the Bay Area because they generate harmful particulate matter: Cemex Construction Materials Pacific, LLC (Cemex), Central Concrete Supply Co., Inc. (Central), and Hanson Aggregates Mid-Pacific, Inc. (Hanson). Because asthma is prevalent in the Bayview Hunters-Point community, particulate matter pollution is of …

The Clinic provides legal and technical assistance to communities that bear a disproportionate pollution burden while enjoying fewer of the benefits and basic amenities such as clean drinking water and open space. We focus on communities in California, although some projects address pollution reduction at the national level. Three core areas continued to dominate our efforts in the last year: clean drinking water for low-income communities, clean energy for California, and air pollution reduction. We also provided legal consulting to numerous organizations that sought our specialized expertise in the areas of clean air, energy, and environmental justice strategy.

In the United States, the environmental justice movement began with a focus on the inequitable burden of toxic exposures placed on low-income minority residents. There is now an increasing recognition that low-income minority residents also often face inequitable access to environmental amenities such as open space, parks and wilderness. Access to Parkland: Environmental Justice at East Bay Parks examines questions of equity for low-income minority residents related to the parkland holdings of the East Bay Regional Park District, the agency that manages close to 100,000 park acres in Alameda and Contra Costa counties east of San Francisco Bay.
