Saving The World Through Zoning: The Sustainable Development Code, Regeneration, And Beyond, Jonathan Rosenbloom, Chris Duerksen

Journal of Comparative Urban Law and Policy

The land use and planning community began to address sustainability at the local level in the 1990s, but in reality, state-of-the-art development codes drafted in the 1990s and early 2000s did little to address climate change, energy conservation, community health, loss of biodiversity, shifting biochemical cycles, racial justice, food supply, and other key sustainability issues. This article reviews past challenges that had to be overcome for sustainable development codes to become mainstream. Local Government Conflict Of Interest In Zoning Actions: Provide For Disqualification Of A Zoning Official When There Is A Conflict Of Interest And Expand Rezoning Applicants' Political Contribution Disclosure Requirements, Bentley Greg Cline

The Act provides for disqualification of a zoning official from voting on a rezoning application where there is a conflict of interest. The Act expands a rezoning applicant's reporting requirements of political contributions to zoning officials. A rezoning applicant's agents (including attorneys) must disclose their contributions. The Act provides for disclosure of political contributions by opponents of rezoning applications.

This Act amends the Metropolitan Rivers Protection Act to require that local governments seeking to override the recommendations of planning commissions in regard to developments in protected river corridors must obtain a finding from the Director of the Environmental Protection Division that the application is consistent with the corridor land and water use plan or will provide protection equivalent to the corridor use plan.
