As exemplified by the articles in this volume, recent scholarship on "authorship" reflects various influences. Among the most important are Michel Foucault's article, What is an Author?, and Benjamin Kaplan's book, An Unhurried View of Copyright. Since the late 1960s, these two texts have influenced work in literary and legal studies respectively. Only recently, however, have the lines of inquiry that Foucault and Kaplan helped to initiate begun to converge.

INTRODUCTION: The remedies section of the Association of American Law Schools decided to hold a panel discussion at its annual meeting in January 1991 on two 1990 Supreme Court cases, Spallone v. United States' and Missouri v. Jenkins, because these cases raise some troubling questions about the implementation of constitutional remedies. Not surprisingly, the State and Local Government Section was also planning a panel discussion about the same cases because they involve federal courts in local governmental decisions. Thus, the two Sections combined their programs into a double, joint session, the proceedings of which are printed here. This article introduces …

Honduran national Manfredo Angel Velasquez Rodriguez was taken to a detention center in Tegucigalpa on September 12, 1981, and was never seen again. He was thirty-five years old when he disappeared, and left a wife and four small children. Without any judicial process he was detained, interrogated and tortured, and then disappeared. A petition concerning the disappearance of Velisquez Rodriguez was filed with the Inter-American Commission on Human Rights (Commission) in October of 1981. On July 29, 1988, an historic day in the fight against governmental human rights abuses in Latin America, the Inter-American Court of Human Rights held that …

Although many states have adopted portions of the Uniform Certification of Questions of Law Act, state-to-state variations thwart the goals of judicial economy, uniformity, and comity among states. An improved act would create consistency and promote greater use of interstate certification.

Part I of this Article describes the role of the judiciary prior to the coup and discusses its response to the human rights abuses of the military regime. Part II presents the principal proposals for reform and discusses them against this historic background. Part III of this Article suggests that these proposals offer a more radical change in the role of the judiciary in Chile than an examination of the …
