Since the approval of the Permanent Apportionment Act of 1929, the number of representatives in the United States House of Representatives has been capped at 435. While the “People’s House” has seen no growth since 1929, the United States population has nearly tripled since that time to 332 million people in 2022. Without additional representatives to accommodate this larger population, Americans have diluted voting power, representatives are more distant from the constituents they supposedly represent, partisanship stonewalls any productive legislation from being passed, an imbalanced Electoral College clouds the will of the people in selecting their president, and a lack …

An Evaluation Of The Rules Of Conduct Governing Legal Representatives In Mediation: Challenges For Rule Drafters And A Response To Jim Mason, Bobette Wolski

This article provides a comparative analysis of the rules of conduct governing legal representatives in Australia, the United States of America and the United Kingdom as they apply to a range of ethical issues in mediation. The analysis has four main aims. First, it clarifies the position in Australia and the USA - the Australian and American mediation communities have not introduced separate codes for ‘mediation advocates’ as Mason recently suggested. But some provisions have been made for mediation practice. The second aim is to tease out from these provisions learning points for policy makers and rule drafters. Amongst the …

Compound Discrimination: The Interaction Of Race And Sex In Employment Discrimination, Elaine W. Shoben

The courts have not yet clearly resolved whether Title VII of the Civil Rights Act of 1964 prohibits compound discrimination, that is, discrimination based on a combination of protected characteristics—such as race and sex-rather than single protected characteristics—such as race alone or sex alone. Professor Shoben argues that both the logic and the legislative history of Title VII support the view that compound discrimination is separately protected. She then offers a systematic method for statistically determining whether an employer is discriminating on the basis of a combination of characteristics. The plaintiffs, local officers of a union, sued to enjoin the national officers of the union from interfering with plaintiffs' union duties. Because the original complaint failed to show diversity of citizenship as a basis for federal jurisdiction, plaintiffs sought by amendment to substitute five nonresident members of the union as parties plaintiff and to change the action to a class suit. The present purpose is to inquire whether, in the matter of the regulation of property rights and of business, legislation has not of late been occupying doubtful, possibly unconstitutional grounds. The discussion in the main must be limited to fundamental.-principles, aided by such light as legal and constitutional history may throw upon them, since the express provisions of the constitutions can give little assistance. They always contain the general guaranty of due process of law to life, liberty, and property, but in other particulars they for the most part leave protection to principles which have come from the common law. …
