Lawyers make mistakes. Read a transcript (your own or that of someone else) or a news media account, go to court and watch, or just learn about it when a colleague describes a trial—with insight and an acknowledgment of missteps or hubris and a peacock display of self-adjudged skill. They are mistakes of omission or commission, but they occur every day. The checklist movement—adapting the checklist model used by surgeons and airplane pilots—is a critical tool for error reduction and elimination and has its place in law.* But beyond granular details that must be checked and double-checked for a particular …

This Article is set amidst the distinctly unsettled and unsettling state of governmental practices, legislative policy, and presidential politics of contemporary America. Immediacy, too, introduces its own uncertainty—as compared to the comfortable vantage point of the distant future. But, as I shall argue, there is no realistic alternative to beginning in medias res. On June 5, 2019, the SEC adopted the Regulation Best Interest Rule Package. The package consists of Regulation Best Interest: The Broker-Dealer Standard of Conduct; Form CRS Relationship Summary and Amendments to Form ADV; Commission Interpretation Regarding Standard of Conduct for Investment Advisers; and Commission Interpretation Regarding the Solely Incidental Prong of the Broker-Dealer Exclusion from the Definition of Investment Adviser. This article will summarize each of the releases.
