Working Sex Words, Anita Bernstein

Michigan Journal of Gender & Law

Imagine yourself tasked to speak for a few minutes about legal controls on sex-selling in the United States, or any other country you choose. You need not have thought about the particulars. As someone willing to read a law review article, you have enough to say because sex-selling overlaps with the subject knowledge you already have. Criminal law, contracts, employment law, immigration law, tort law, zoning, commercial law, and intellectual property, among other legal categories, all intersect with this topic. In your brief remarks on how law attempts to mediate the sale and purchase of sex, you have only one …

Master of Studies in Law Research Papers Repository

On December 6, 2014, Parliament enacted new criminal law addressing prostitution related offences in response to the 2013 decision at the Supreme Court in the matter of Bedford v Attorney General of Canada. This major research paper focuses on the criminal law concerning prostitution and sex work and the impact of the law on people who work in the sex trade. This major research paper analyses the new criminal law, and its stated purpose by critically examining the research materials used to help inform those who drafted the law, to conclude that the law is flawed. Parliament has ignored …

Rethinking Red Lights: An Economic Approach To Appalachian Prostitution Laws, Kandi Spindler May 2017

Rethinking Red Lights: An Economic Approach To Appalachian Prostitution Laws, Kandi Spindler

DePaul Journal of Women, Gender and the Law

The legal discourse surrounding prostitution frequently drowns out the voices of sex workers themselves by focusing on questions of morality. But ignoring the voices of those affected by prostitution laws also ignores the driving force behind prostitution: economics. This Note departs from a traditional case study by using interviews with chiefly sex workers and brothel management to craft a more efficient and fair mode of regulating prostitution. By viewing prostitution for what it is—an industry driven by basic economic principles—business law becomes the clear choice for replacing the current, ineffective laws. Furthermore, reshaping prostitution laws to meet the monetary needs …

Making Sex Work For The State : The Policing Of Sex Work In The United States., Madeline A Clabough May 2017

Making Sex Work For The State : The Policing Of Sex Work In The United States., Madeline A Clabough

College of Arts & Sciences Senior Honors Theses

This thesis analyzes the ways that sex work is regulated within the United States, and analyze the ways that regulation is shaped by contemporary feminist discourse. To do so, it analyzes the ways in which sex workers have been and pathologized since the 19th century, and address the ways that these conceptualizations have been incorporated into the legal regulation of sex workers. Finally, this thesis will look to contemporary practices in the state regulation of sex workers, and argue that the relationship between neoliberalism, the carceral state, and what has come to be termed “carceral feminism” operate in conjunction to …

New Hampshire Juvenile Sex Trafficking Survivor Urges Representatives To Vote Against Decriminalized Prostitution, Darlene Pawlik, Donna M. Hughes Dr. Feb 2017

New Hampshire Juvenile Sex Trafficking Survivor Urges Representatives To Vote Against Decriminalized Prostitution, Darlene Pawlik, Donna M. Hughes Dr.

Donna M. Hughes

I am a juvenile sex trafficking survivor. I was sold here in New Hampshire and other states as well. This is happening now too. Even with a law against prostitution, the more egregious elements are prevalent. Trafficking is not separate from prostitution, it is just the darker side of the very same coin.

Sex Industry Advocates Aim To Decriminalize Prostitution In New Hampshire, Kelly Roy-Williams, Lisa Thompson, Donna M. Hughes Dr. Feb 2017

Sex Industry Advocates Aim To Decriminalize Prostitution In New Hampshire, Kelly Roy-Williams, Lisa Thompson, Donna M. Hughes Dr.

Donna M. Hughes

There is an organized effort in New Hampshire to fully decriminalize prostitution. What that means is that all laws controlling the buying and selling of sex will be removed from the law books, making prostitution legal. Law enforcement and public officials will then have no control over if, when, and where prostitution occurs, whether it’s in massage parlors (often called spas), hotels, apartments, residences, or strip clubs. Because commercial sex will be legal, pimps and “sex workers” will be able to freely advertise prostitution services. Pimps will be able to openly recruit women and girls into prostitution, without fear of …
