On December 6, 2014, Parliament enacted new criminal law addressing prostitution related offences in response to the 2013 decision at the Supreme Court in the matter of Bedford v Attorney General of Canada. This major research paper focuses on the criminal law concerning prostitution and sex work and the impact of the law on people who work in the sex trade. This major research paper analyses the new criminal law, and its stated purpose by critically examining the research materials used to help inform those who drafted the law, to conclude that the law is flawed. Rethinking Red Lights: An Economic Approach To Appalachian Prostitution Laws, Kandi Spindler

The legal discourse surrounding prostitution frequently drowns out the voices of sex workers themselves by focusing on questions of morality. But ignoring the voices of those affected by prostitution laws also ignores the driving force behind prostitution: economics. This Note departs from a traditional case study by using interviews with chiefly sex workers and brothel management to craft a more efficient and fair mode of regulating prostitution. By viewing prostitution for what it is—an industry driven by basic economic principles—business law becomes the clear choice for replacing the current, ineffective laws. Making Sex Work For The State : The Policing Of Sex Work In The United States., Madeline A Clabough

This thesis analyzes the ways that sex work is regulated within the United States, and analyze the ways that regulation is shaped by contemporary feminist discourse. To do so, it analyzes the ways in which sex workers have been and pathologized since the 19th century, and address the ways that these conceptualizations have been incorporated into the legal regulation of sex workers. Finally, this thesis will look to contemporary practices in the state regulation of sex workers, and argue that the relationship between neoliberalism, the carceral state, and what has come to be termed “carceral feminism” operate in conjunction to …
