The paper examines the requirements of each section of Illinois Code of Civil Procedure Section 2-619(a) in greater depth by examining appellate and Illinois Supreme Court rulings in cases brought under each section of 2-619(a). It also analyzes the standards of review appellate courts apply under each section of 2-619(a). Finally, because 619(a) motions require affidavits in support of the motion, it is also necessary to consider the nature and sufficiency of affidavits.

En este artículo se analiza de manera crítica el proceso único de ejecución de desalojo comprendido en el Decreto Legislativo N.º 1177, aplicable a las modalidades contractuales reglamentadas por esta norma: arrendamiento de inmueble destinado a vivienda (arrendamiento tradicional), arrendamiento de inmueble destinado a vivienda con opción de compra, y arrendamiento financiero (leasing) de inmueble destinado a vivienda. Como lo hace ver el autor, destacan como particularidades (novedades) de la nueva regulación la posibilidad de demandar el desalojo por terminación del contrato siempre que se dejen de pagar dos (02) meses consecutivos (supuesto distinto del contemplado en el Código Civil) …

Una correcta definición de poseedor precario pasa por establecer una noción, lo más exacta posible, del ‘título’ a que se refiere el artículo 911 del Código Civil. El fundamento del pago por consignación, es el derecho del deudor a pagar, ello justifica que la ley peruana regule el pago por consignación. Por lo que no es justo que continúe vinculado indefinidamente y es por ello que debe disponer de un procedimiento o mecanismo para liberarse.

In line with Lenin’s famous quote that Bolsheviks “do not recognise anything private” and that private law must be permeated with public interest, the private (civil) law of the USSR and other countries of the Soviet bloc, including Poland underwent reform aimed at furthering the public interest at the expense of the private one. Specific legal institutions were introduced for this purpose, in the form of legal innovations, loosely, if at all, based on pre-existing Western models. In most civil cases filed today, discovery is likely to include electronically stored information (“ESI”). This article details the steps counsel must take when a lawsuit filed, and the article gives particularized instruction on ESI at each juncture. The article discusses the following steps: At Step One, the judge issues an initial scheduling order, which puts into motion several deadlines: the Rule 26(f) conference, the date to submit the parties’ planning report, and the Rule 16 Conference. A 2010 survey of Illinois Civil Procedure discussed recent amendments to the Illinois Supreme Court Rules that apply to civil practice issues.1 The survey began with Notices of Appeal and a substantial part of the survey of Notices of Appeal was devoted to Secura Insurance Co. v. Illinois Farmers Insurance Co.2 The purpose of this Article is to examine in greater depth the requirements of filing notices of appeal under Illinois Supreme Court Rule 12(b)(3) and the corresponding proof of service of Rule 373.
