Leadership includes the ability to persuade others to embrace one’s ideas and to act upon them. Teaching law students the art of persuasion through advocacy is at the heart of legal education. But historically law schools have not included leadership studies in the curriculum. Clinical Legal Education In Dutch Legal Culture: Clashes Of Tradition, Tolerance, And Progress In Global Law's Capital, Richard J. Wilson

This paper examines the current context of legal education within Dutch legal culture as a case study focusing on the growing role of clinical legal education in the Netherlands, a progressive country in Western Europe, where traditional legal education has held sway for centuries. The Dutch experience with clinical legal education, though limited, is expanding even as the traditional apprenticeship phase of law training there is undergoing major reform, responsive to the growth of "big law." Students complain that they do not get enough feedback on their progress through the year. Faculty members complain that students cannot write, although they often mean that students cannot analyze in writing. But mid-semester examinations are a pain to grade and often do not cover enough material to challenge students in recognizing the issues. Multiple choice examinations are weak choices for issue spotting, time consuming to construct, and offer no opportunity for writing. This paper discusses the Critical Review Exam System [CRES] developed by Alan Tyree in Australia in which the computer poses a question requiring an essay answer. After the student answer has been "submitted," the computer asks the student a number of simple yes/no questions about the submitted answer. In effect, students mark their own answer. The "critical review" questions may be arranged in a tree structure, thus facilitating the use of questions which have no "right" answer.

This article reexamines an earlier experiment in the use of blogs in teaching negotiation when undertaken in a different cultural environ ment. I briefly examine two core factors — technical competence and cultural preferences in communication — as well as a student prefer ence to reserve the use of social media for purely social and informal communications. Parallels are also drawn with the technical and cultural contexts of developments in online dispute resolution.

Based on a presentation at the Law, Medicine and Health Care section meeting at the Annual Meeting of the AALS in January 2012, this paper describes the impact that co-ops have for health law students and faculty. Co-ops are the four 10 to 11 week full-time legal placements that Northeastern University School of Law requires of all J.D. students. This study empirically tests the proposition that law students adopt different conceptions of the judge’s role in adjudication based on whether they first study intentional torts, negligence, or strict liability. The authors conducted an anonymous survey of more than 450 students enrolled in eight law schools at the beginning, mid-point, and end of the first semester of law school. The students were prompted to indicate to what extent they believed the judge’s role to be one of rule application and, conversely, to what extent it was one of considering social, economic, and ideological factors. This article, prepared as a follow-up to Salkin & Nolon, Practically Grounded: Convergence of Land Use Pedagogy and Best Practice, 60 J.Legal Education 519 (2011), describes how practice-based assignments can supplement the traditional casebook method of instruction to meet goals and measure outcome assessments for students in the course. The article is based on my own course goals and explains how each assignment relates to individual outcome assessments.
