Do Guaranteed-Low-Price Policies Guarantee High Prices, And Can Antitrust Rise To The Challenge?, Aaron S. Edlin Nov 1997

Do Guaranteed-Low-Price Policies Guarantee High Prices, And Can Antitrust Rise To The Challenge?, Aaron S. Edlin

Aaron Edlin

Price-matching policies can be highly anticompetitive. They allow firms to raise their prices above competition levels by discriminating in price between informed and uninformed customers. The resulting high prices can persist even when new firms enter the industry, a fact that gives price matching the potential to be much more socially costly than an ordinary monopoly or cartel. At the same time, widespread entry implies that the agreement among sellers that is typical of a Sherman Act price-fixing case may be absent. In this article, Professor Edlin argues that there is nonetheless an analogy between a seller offering (and agreeing) …

The Extent Of Congress’ Power Under The Full Faith And Credit Clause, Rex D. Glensy Nov 1997

The Extent Of Congress’ Power Under The Full Faith And Credit Clause, Rex D. Glensy

Rex Glensy

This Note analyzes the enabling provision of the Full Faith and Credit Clause of the U.S. Constitution to determine the extent of Congress’s power thereunder. It traces the meaning of the provision from that intended by the framers of the Constitution through the present day by describing the historical background of the provision’s enactment as well as court decisions and statutes pertaining to it. The Note concludes by articulating a meaning for the enabling provision of the Full Faith and Credit Clause and shows that Congress exceeded its power pursuant thereto when it passed recent legislation limiting the full faith …

The Prevalence Of Pulmonary And Upper Respiratory Tract Symptoms And Spirometric Test Findings Among Newspaper Pressroom Workers Exposed To Solvents, Dean M. Hashimoto, Burton W. Lee, Karl T. Kelsey, Barbara Yakes, Teresa Seitz, David Christiani Sep 1997

The Prevalence Of Pulmonary And Upper Respiratory Tract Symptoms And Spirometric Test Findings Among Newspaper Pressroom Workers Exposed To Solvents, Dean M. Hashimoto, Burton W. Lee, Karl T. Kelsey, Barbara Yakes, Teresa Seitz, David Christiani

Dean M. Hashimoto

To investigate the relationship between exposure to organic solvents and the presence of pulmonary and upper respiratory tract mucous membrane symptoms, we conducted a cross-sectional study of 215 newspaper pressroom workers who were occupationally exposed to organic solvent and lubricant mixtures. Thirty-four compositors, who were not occupationally exposed to the solvents or lubricants, served as controls. Pressroom workers and compositors underwent spirometric testing and were also asked about the presence of cough, phlegm, hemoptysis, dyspnea, wheezing, chest tightness, nose or throat irritation, eye irritation, and sinus trouble. The spirometric results did not significantly differ between the two groups. However, the …

The Little Rock Crisis And Foreign Affairs: Race, Resistance, And The Image Of American Democracy, Mary L. Dudziak Sep 1997

The Little Rock Crisis And Foreign Affairs: Race, Resistance, And The Image Of American Democracy, Mary L. Dudziak

Mary L. Dudziak

When President Dwight D. Eisenhower sent federal troops to Little Rock, Arkansas to enforce a school desegregation order at Central High School in the fall of 1957, more than racial equality was at issue. The image of American democracy was at stake. The Little Rock crisis played out on a world stage, as news media around the world covered the crisis. During the weeks of impasse leading up to Eisenhower's dramatic intervention, foreign critics questioned how the United States could argue that its democratic system of government was a model for others to follow when racial segregation was tolerated in …

Doma: An Unconstitutional Establishment Of Fundamentalist Christianity, James M. Donovan Aug 1997

Doma: An Unconstitutional Establishment Of Fundamentalist Christianity, James M. Donovan

James M. Donovan

This Article scrutinizes the constitutionality of the intent of the Defense of Marriage Act [DOMA]. According to the text of the Act, DOMA's purposes are "to define and protect the institution of marriage," where marriage is defined to exclude same-sex partners. To be constitutionally valid under the Establishment Clause, this notion that heterosexual marriage requires "protection" from gay and lesbian persons must spring from a secular and not religious source. This Article posits that DOMA has crossed this forbidden line between the secular and the religious. DOMA, motivated and supported by fundamentalist Christian ideology, and lacking any genuine secular goals …

Two submissive souls appearing docile to the core--one 14 year old Manoj with his wrist in one of the hand cuffs while another wrist locked up with that of Jawahir, a 30 year old lean and thin man. These unusual mates stepped down from an Auto with a constable. I say mates because they were sharing the load of the iron chain wrapped around in layers. We could not believe ourselves that all this could happen in the heart of the capital, at Deen Dayal Upadhyay Hospital, Delhi.
