Technology On The Factory Floor Ii: Benchmarking Manufacturing Technology Use In The Usa, Paul Swamidass

This monograph is the result of the second joint effort of the Manufacturing Institute of the National Association of Manufacturers (NAM) and the author for studying the use of fifteen different manufacturing technologies in the US. Timely support by the National Science Foundation enabled this second study to be expanded to a larger number of participants. A total of 1,121 members of NAM participated in this study. Hard technologies studied were: AGV, CAD, CAM, CIM, CNC, FMS, LAN, Robotics and automated inspection, and soft technologies studied were: TQM, JIT, SQC, MRP, MRP II, and manufacturing cells.

Must We Teach Abstinence? Pensions' Relationship Investments And The Lessons Of Fiduciary Duty, Ethan G. Stone

Commentators have speculated that pension funds do not act as activist investors because of the constraints of fiduciary duties under ERISA. This note examines the case law under ERISA and the common law of trusts on which it is based and concludes that there are no legal constraints. The institutional incentives of the people who manage pension funds seem a better explanation for their inactivity (assuming that activism is, in fact, cost-justified).

In 1993, Lani Guinier was nominated to head the Justice Department's Civil Rights Division. Her nomination was withdrawn after she was accused of being too liberal, if not radical, on issues relating to voting rights law. This article discusses her views, and finds that her writings were not clear enough to either support or debunk the accusations of radicalism.

Certainty, Efficiency, And Realism: Rights In Collateral Under Article 9 Of The Uniform Commercial Code, Margit Livingston

Article 9 of the Uniform Commercial Code requires that the debtor have "rights in the collateral" for the attachment of a security interest. The drafters, however, left the determination of the phrase's meaning to the courts. This article argues that the requirement of "rights in the collateral" is unnecessary as it relates to tangible goods and should be deleted from Article 9. As an alternative to the uncertainty engendered by the phrase, the article proposes substituting a set of notice and priority rules that more clearly define the rights and obligations of the parties undertaking an Article 9 transaction involving …

Throughout modern history, there have only been three internationally established commissions to investigate war crimes and prepare for eventual prosecutions before international and national judicial bodies: the 1919 Commission on the Responsibilities of the Authors of the War and on Enforcement of Penalties for Violations of the Laws and Customs of War (1919 Commission), the 1943 United Nations War Crimes Commission (UNWCC), and the Commission of Experts established pursuant to Security Council Resolution 780 (1992) to investigate violations of international humanitarian law in the former Yugoslavia (Commission of Experts). The recent discovery that an anonymously published 1620 essay was an early writing of Thomas Hobbes invites investigation of his early thinking. Hobbes relied on mostly classical sources to advance a basically conventionalist theory of law and to anticipate twentieth century analyses of the principles of rule of law such as those made famous by F. A. Hayek and Michael Oakeshott.

In the case of Kerr and Schwarzschild black holes there exist continuous standing wave solutions in the total interval (r is greater than 0 and less than infinite) at certain real frequencies. This means that we can see into these black holes at these frequencies with gravitational-wave detectors, studying the radial structure inside the event horizon, too.
