Should Asbestos In Buildings Be Regulated On An Environmental Or Occupational Basis?, Dean M. Hashimoto, Troyen A. Brennan, David C. Christiani Nov 1991

Should Asbestos In Buildings Be Regulated On An Environmental Or Occupational Basis?, Dean M. Hashimoto, Troyen A. Brennan, David C. Christiani

Dean M. Hashimoto

The issue of asbestos abatement in buildings may be viewed as part of a larger and more fundamental scientific and social issue: Should asbestos in buildings be regulated on an environmental or an occupational basis? The environmental approach to regulation of hazardous substances has a different emphasis from that of an occupational approach. The environmental approach emphasizes abatement of property damage, while the occupational approach is more concerned with decreased exposure levels and compensation for injuries to health. Similarly, the justifications for the two approaches also have a different emphasis. The need for environmental protection is justified on the basis …

Por Un Nuevo Régimen De Bienes En El Matrimonio, Enrique Barros Bourie

Enrique Barros Bourie

No subject in the Civil Code has been the objective of so many successive reforms since its enactment in 1855 as the marital partnership, which constitutes the basic economic order of the family. This study shows that those successive reforms have caused practical irremediable inconsistencies by intending, on the one hand, to expand the participation and capacity of women and, on the other, conserving the principle of an association of assets administrated by the husband. On the basis of that diagnosis, a proposal is made to establish a new legal marital property regimen: the share in joint property. It is …

Intellectual Property Protection For The Creative Chef, Or How To Copyright A Cake: A Modest Proposal, Malla Pollack

Malla Pollack

This Note presents an original proposal for extending copyright protection to food (not to the appearance of the food, nor to the recipe for the food, but to the food itself). Because of the unusual nature of the suggestion, the Note begins with a detailed statement of the proposal: the intended beneficiaries, the dearth of current protection, and the recommended judicial action. It then covers the proposal's relationship to the Constitution and the legislative history of the 1976 Copyright Act. Finally, the Note briefly discuss the proposal's administrability. The Note also includes several wonderful recipes -- especially the epidome of …
