A case like Kivalina seeking damages from 24 of the biggest US oil and power companies for their alleged contributionto global warming has not yet been brought before the German Courts. The article deals with the the question if such a claim could be based on ยง 1004 of the German Civil Code (BGB) and analyses the rules of proving causality in distant and additive damage cases.
