Paternalistic Interventions In Civil Rights And Poverty Law: A Case Study Of Environmental Justice, Anthony V. Alfieri

Low-income communities of color in Miami and in cities across the nation both share aspirations of equal justice and democratic participation and suffer the burdens of legal underrepresentation and political disenfranchisement. Such burdens become crippling when, as in Miami, local legal aid offices, public interest organizations, and bar associations lack the resources to provide meaningful private access to justice or to muster significant public engagement in the political process. These burdens become especially crippling when, again as in Miami, local and state governments adopt policies that engender inner-city neglect, economic displacement, and racial exclusion. From Dyad To Triad: Reconceptualizing The Lawyer-Client Relationship For Litigation In Regional Human Rights Commissions, Melissa E. Crow

This Article analyzes the standing requirements for NGO petitions to the Inter-American and African Commissions and explores the ways which they may undermine the legitimacy and effectiveness of each of these for a, especially in the context of litigation on behalf of groups. The author evaluates various proposals for addressing these problems based on princeiples of class action and client-centered lawyering and concludes that they are inadequate.

Since the leasing of its office in August 1965, the Washtenaw County Legal Aid Society has been open nearly 50 hours per week and has been staffed exclusively by second and third-year law students from the University of Michigan Law School. The bulk of the practice has been in family law--divorce, support, custody--but there have been a substantial number of creditor-debtor cases, a handful of misdemeanor defense cases, and a large batch of miscellaneous cases.
