This thesis discusses the main problems that face tax authorities of many countries in the process of taxation of electronic commerce. It analyzes examples of problems posed by the growth of e-commerce in the context international direct and indirect taxation. This thesis analyzes the evolution of the arm's length standard (ALS) as the key element of the transfer pricing control system in the US. This thesis also addresses some issues on creation of transfer pricing legislation in the Russian Federation and focuses on three sets of problems. Generally, reasonable expenses incurred in the ordinary and necessary course of a legitimate trade or business are deductible from gross income under the U.S. Tax Code; however in an effort to curb tobacco use, recent legislation has disallowed this benefit to tobacco companies for advertising expenses. The judiciary has upheld this disallowance under the doctrine of legislative grace. The national debt and federal deficit spending has far-reaching economic consequences in the United States and abroad. This thesis focuses on the legal aspects involved in controlling public expenditure, seeking to develop procedural and substantive legal rules to restrain public spending and help balance the federal budget. Since other governments face similar budget concerns, the anti-deficit measures utilized by the governments of Canada, European nations, and U.S. states are examined. The successful measures from these other governments along with improvements to the current federal approach are proposed to optimize the federal approach to the budget crisis.
