The pandemic experience has made it clear that not everyone loves teaching or learning remotely. Many professors and students alike are eager to return to the classroom. However, our experiences over the last year and a half have also demonstrated the potentials and possibilities of learning online and have caused many professors to recalibrate their approaches to digital learning. While the tools for online learning were available well before March of 2020, many instructors are only now beginning to capitalize on their potential. We argue that the increasing role of scholarly impact in determining a school’s status will provide a new opportunity for libraries to assume a critical institutional role behind its traditional support of scholarship and teaching. In practice, this increased role can evolve in a multitude of ways. Based on the data used here, a strong argument can be made in favor of each library taking charge of both their faculty scholarly impact and publication of its school’s journals. This article discusses the results of a study into the open access availability of law reviews, followed by a discussion of why open access has such a high rate of adoption among law reviews, especially in comparison to the journal literature in other disciplines.

There has been a dramatic rise in the number of law libraries managing institutional repositories for their law schools. In 2011, there were some 30 law schools with such repositories; now, 80 of the top 100 law schools have their own or participate in a university-wide repository wherein the law school has an identifiable, school-specific collection or community. This article discusses a survey of the of the top 101 law schools, in hopes of facilitating an understanding of the breadth of material to be found in law school institutional repositories.

The article under consideration in this symposium issue, “Foreign Attorneys in U.S. LL.M. Programs: Who’s In, Who’s Out, and Who They Are,” by Mindie Lazarus-Black and Julie Globokar, comes at a critical moment for law schools, especially those below the top tier. Many schools are reducing class size, offering unprecedented financial aid and scholarship packages, and entering a general retrenchment mode. This most recent crisis in law school applications and enrollment (applications are down at some schools by over 30 percent) has led to an increase in the popularity of Master of Laws (LL.M.) programs for foreign attorneys. The dual crises facing legal education - the economic crisis affecting both the job market and the pool of law school applicants, and the crisis of confidence in the ability of law schools and the ABA accreditation process to meet the needs of lawyers or society at large - have undermined the case for not only the autonomy, but the very existence, of law school libraries as we have known them. Libraries and librarians generally aspire to provide the best services they can to their user communities. But what does that mean? Assumptions about what is needed may not necessarily align with the actual preferences of a given user group. In this column, Seth Quidachay-Swan presents a case study that explores the interaction between time of day and medium of information delivery. Examining data gathered in a law library environment, the author concludes that modern presumptions about the diminishing need for traditional information services may not allow for effectively managing user expectations.

How Money For Legal Scholarship Disadvantages Feminism, Martha T. Mccluskey

A dramatic infusion of outside money has shaped legal theory over the last several decades, largely to the detriment of feminist theory. Nonetheless, the pervasive influence of this funding is largely ignored in scholarly discussions of legal theory. This denial helps reinforce the marginal position of feminist scholarship and of women in legal theory. Conservative activists and funders have understood the central role of developing community culture and institutions, and have helped shift the prevailing framework for discussion of many questions of theory and policy through substantial investments in law-and-economics centers and in the Federalist Society. Becoming Gentlemen: Women's Experiences At One Ivy League Law School, Lani Guinier, Michelle Fine, Jane Balin, Ann Bartow, Deborah Lee Stachel

In this Article we describe preliminary research by and about women law students at the University of Pennsylvania Law School—a typical, if elite, law school stratified deeply along gender lines. Our database draws from students enrolled at the Law School between 1987 and 1992, and includes academic performance data from 981 students, self-reported survey data from 366 students, written narratives from 104 students, and group-level interview data of approximately eighty female and male students.' From these data we conclude that the law school experience of women in the aggregate differs markedly from that of their male peers.
