Ocean Zoning For The Gulf Of Maine: A Background Paper, Fara Courtney, Jack Wiggin

Coastal and ocean management is a constantly evolving practice. For at least two decades, coastal communities around the world have been experimenting with new ways to control a multitude of activities in their urban and rural harbors. The number and diversity of Marine Protected Areas are growing, with an increasing focus on protecting integrated biological communities, rather than individual species of concern. The United States and Canada are each developing new, comprehensive ocean polices, looking to better integrate management functions at all levels of government.

All of these initiatives – from local to national - reflect some common truths about …

The Government recognises that the mackerel fishery is important to both the recreational and commercial fishing sectors. However, the purpose of these arrangements is not to allocate the mackerel resource between the sectors but within the commercial sector. Resources sharing issues are subject to investigation in the Integrated Fisheries Management Review where alternative management frameworks and principles for allocating fish stocks to ensure maximum benefit to the community are examined.

The Americans with Disabilities Act (ADA) requires that persons with disabilities be integrated to the maximum extent possible, and that these persons cannot be excluded from participation. Intramural directors need to be proactive in this area. The benefits of intramural sports are vast, and they help many students become part of the college community.

Forming an alliance with the Disability Services on campus, the first step, is the most vital aspect of making these programs successful. It is important to remember the difference between what can be done and what must be done. Even with the best of intentions, it …

Two versions of the draft Bycatch Action Plan for the Shark Bay Prawn Managed Fishery have been released for public comment. The ‘Full Report’ (this document - Fisheries Management Paper No. 147) is a comprehensive version of the plan containing detailed rationale and justification for the objectives and actions proposed in the plan. The Full Report also provides detailed background information regarding issues such as the natural environment in Shark Bay, current management arrangements within the prawn fishery and existing information on bycatch. This Management Paper is intended to assist the Executive Director when considering the issuing of authorisations for commercial aquaculture under Section 92 of the Fish Resources Management Act 1994; written approvals or written authorities for the translocation of barramundi under Regulation 176 of the Fish Resources Management Regulations 1995; and in the development of programs for recreational fishery enhancement of barramundi. It is also designed to provide guidance to the aquaculture industry and recreational fishing groups when considering the farming or stocking of barramundi in this State.

In order for agricultural biotechnology (agri-biotech) to play a larger role in the development of sustainable agricultural systems, intellectual property (IP) rights management must be addressed. These issues are not limited to developing countries. With increased globalization, the management of agri-biotech IP rights affects both developing and industrialized countries. In industrialized countries, for example, IP rights risk management entails protection of inventions via strong patent portfolios. For developing countries, IP rights risk management includes the acquisition of rights requisite for the use of inventions essential to the basic welfare of the population. The New Environmental Law: Forest Certification, Errol E. Meidinger

Journal Articles

This paper argues that the rapidly expanding practice of forest certification, together with similar developments in other sectors, is creating a new template for environmental law. Nongovernmental organizations and some industry actors are establishing binding regulatory standards, systems for monitoring compliance, sanctions for non-compliance, and, when things work well, methods for assessment and revision. It locates these developments as a part of “phase 3” of environmental law, which also involves a proliferation of other initiatives beyond traditional regulation. Finally, it offers a preliminary discussion of the efficacy, adaptability, coherence, and legitimacy of the emergent system.
