Of Two Minds About Law And Minds, Larry Alexander

Present-oriented interpretation is an interpretive approach to legal texts that assigns them the best meaning, in terms of contemporary social policy, that they could plausibly convey were they written today rather than at the actual times of their enactment. Steven Smith has recently argued that present-oriented interpretation is a view of law in which law is literally "mindless." That is, present-oriented interpretation would have us be ruled by the fortuity of what present meanings the words of a text can bear, whereas, according to Smith, we should be ruled by what the enacting political authorities actually decided furthers the public …

In this action, Plaintiffs sought a writ of mandamus compelling the offending judges to write better, but the court below denied the writ. Plaintiffs then petitioned for relief from poor writing. Because some judges do, in fact, write clear and effective opinions, we have granted certiorari to resolve the differences between the various courts. The issue before us, then, is whether judges and clerks have abused their discretion by writing weak opinions and, if so, how they can improve their writing. Because stronger writing greatly eases the reader's job and makes opinions more effective, we hold that judges and clerks …

Project Clear's Paper Choice: A Hypertext System For Giving Advice About Legal Research, I. Trotter Hardy

Project CLEAR-Computers in Legal Education: Assistance with Research-applies computer techniques to teaching and advising students about legal research. "Hypertext" is a software technique appropriate both for creating information structures that users can browse through, and for creating question-and-answer decision trees that provide specific advice to users. These two hypertext techniques have been put together in Project CLEAR's Paper Choice, a computer program that provides knowledge and gives advice to law students about legal research.

From The Bar To The Bar: Prevailing Despite Gender Bias, Nancy Woolley

New England Journal of Public Policy

The report of the Gender Bias Study of the Supreme Judicial Court of the Commonwealth of Massachusetts was released in May 1989. After a thorough study of the areas of family law, domestic violence and sexual assault, criminal and juvenile justice, civil damage awards, gender bias in courthouse interactions, and court personnel, the study committee concluded that there was significant gender-based bias in the courts. Scholarship Amok: Excesses In The Pursuit Of Truth And Tenure, Kenneth Lasson

In 1937, when Fred Rodell issued his once-famous diatribe, some 150 law-related journals were being published (not to mention thousands of local newspapers and countless full-color comic books). Now there are over eight hundred legal periodicals (not to mention a drastically dwindled number of daily papers, and precious few comics). Both Solomon and Rodell have been all but forgotten. What, indeed, have we wrought? English-Japanese: The Dictionary of Anglo-American Law, published by the University of Tokyo Press, represents a tremendous achievement. Its publication in 1991 culminated a'seven-year effort in which more than fifty leading Japanese scholars actively participated. These included specialists in a wide range of fields, not just professors of Anglo-American law. The effort was overseen-and a heavy share of the work borne by-a seven-member Editorial Committee, which held more than 150 meetings in the process of preparing the dictionary. Based on accounts I have received from many of the professors who participated in the project, however, it is clear that the …

For some time I have been working on the problem of judicial criticism, focusing especially on the question: What is it in the work of a judge that leads us to admire a judicial opinion with the result of which we disagree, or to condemn an opinion that "comes out" the way we would do if we were charged with the responsibility of decision?
