Critical lawyering—also at times called rebellious, community, and movement lawyering—attempts to further social justice alongside impacted communities. While much has been written about the contours of this form of lawyering and case examples illustrating core principles, little has been written about the mechanics of teaching critical lawyering skills. This Article seeks to expand critical lawyering theory, and in doing so, provide an example of a pedagogical approach to teaching what we term “critical interviewing.” Critical interviewing means using an intersectional lens to collaborate with clients, communities, interviewing partners, and interpreters in a legal interview. Setting The Health Justice Agenda: Addressing Health Inequity And Injustice In The Post-Pandemic Clinic, Emily Benfer, James Bhandary-Alexander, Yael Cannon, Medha D. Makhlouf, Tomar Pierson-Brown

The COVID-19 pandemic surfaced and deepened entrenched preexisting health injustice in the United States. Racialized, marginalized, poor, and hyper-exploited populations suffered disproportionately negative outcomes due to the pandemic. The structures that generate and sustain health inequity in the United States—including in access to justice, housing, health care, employment, and education—have produced predictably disparate results. The authors, law school clinicians and professors involved with medical-legal partnerships, discuss the lessons learned by employing a health justice framework in teaching students to address issues of health inequity during the pandemic. Law professors are all about ideas, and the creation of an institute, clinic, or center within a law school is the instantiation of an idea. Ideas embodied in law school institutions become crystallized in the fabric of a school, changing its culture, internalizing its values, and reflecting its priorities. Robert Cochran has helped to establish multiple institutes, centers, and clinics at Pepperdine Caruso Law School, and in so doing he has become the law school's great serial entrepreneur. Are You Experienced? - Simple Timesheets For Experiential Learning Courses, Eleanor C. Lanier, Leslie Grove

ABA Standards require students to complete six credit hours of experiential learning. Hours must be tracked, and field placements in particular require students to keep logs of their activities to document compliance. Various web-based solutions are used, including “high-end suites like CORE ELMS, the Symplicity experiential learning module, and the basic and free Dropbox and Google Suite” as well as Canvas, and a time-tracking program called Tick. Here at the University of Georgia School of Law, we decided to add simple timesheet functionality to our Drupal-based student portal, allowing students to securely log their hours and activities, and faculty to …

Because of Georgia’s unique court structure and political challenges, state advocates were unable to secure funding for a spot in the WINGS nest. But there is good news. The bonds we forged over our many years of advocacy on guardianship issues, and our effort to pull together the (unsuccessful) WINGS application, helped a few of our ideas take flight. This article highlights one highly successful and easily replicable effort that can be undertaken for a local court, in a region or at the state level, depending on resources and interest.

Founded in January 2016, the Wilbanks Child Endangerment and Sexual Exploitation Clinic (the CEASE Clinic) represents survivors of child sexual abuse in juvenile court dependency matters and civil litigation and is the first of its kind in the nation. The CEASE Clinic was established through a generous donation by Georgia Law alumnus Marlan Wilbanks (JD ‘84) in response to a new Georgia law known as the Hidden Predator Act (the HPA) that went into effect on July 1, 2015. The HPA extended the statute of limitations for civil claims arising out of acts of child sexual abuse by providing a …

For lawyers, learning law by practicing law is customary. In the world of legal education, learning from practice is situated in both acceptance and opposition. There are practical arguments in its favor—the practicing bar wants law graduates to be “practice ready,” and theoretical arguments—understanding how law operates in the real world yields a clearer understanding of law itself, how it maintains social and economic structures, and how it impacts individuals. This Article posits that the University of Georgia School of Law for Clinical Programs course syllabi demonstrate implementation of recommendations found in leading works that advocate for change in traditional legal education. This Article reviews some high points of legal education reform with a focus on clinical legal education and then discusses the role of syllabi in the classroom and the potential within the document that many professors miss. This Article then turns to using syllabi to measure the extent that the clinics are implementing instruction that addresses all three apprenticeships as defined in the Carnegie Report.. Learning In "Baby Jail": Lessons From Law Student Engagement In Family Detention Centers, Lindsay M. Harris

Between 2014 and 2017, more than 40 law schools and likely well over 1000 law students engaged in learning within immigration family detention centers. The Trump Administration’s “zero tolerance” policy and implementation of wide-scale family separation in 2018 led to increased involvement by professors and students in the constantly shifting landscape of immigration detention. As the detention of immigrant families becomes increasingly entrenched, this article hits the pause button and assesses the benefits and challenges of the various approaches to, and proposes some principles for, law student engagement in this crisis lawyering in immigration detention centers, for families, and beyond.

Externship Assessment Project: An Empirical Study Of Supervisor Evaluations Of Extern Work Performance, Margaret Reuter

Field supervisors’ evaluations of their student externs are packed with lively stories. They deliver a fly-on-the-wall perspective, giving us color about the work entrusted to our students, the behaviors our students exhibited, and the enjoyment the attorneys reaped. The authors decided the evaluations were so fertile that they should be systematically scrutinized to seek meaningful, reliable insights about the extern experience, especially regarding the variety, complexity, and responsibility levels of their work. We also saw a prime opportunity to assess an externship program and find ways to improve it. Thus, the Externship Assessment Project was born. We deployed qualitative data …

The Public Interest Practicum (PIP), a course at the University of Georgia School of Law, fosters awareness among law students of the demand for access to justice. For more than 25 years, PIP has served many purposes: to explore a street level jurisprudence; to challenge students’ professional identities; to generate new models of clinical legal education; to inculcate the habit of public service; and to help individuals with legal problems. Through its many iterations, PIP has consistently exposed future lawyers to ways of helping those in need. This reflection traces the history of PIP as a course, contextualizes it within …
