The number of empirical legal studies published by academic journals is on the rise. Given theory’s dominance over the last few decades, this is a welcome development. This movement, however, has been plagued by a lack of rigor and a failure of editors to require disclosure of data and procedures that allow for easy replication of published results. Law journals, the editorial boards of which are manned solely by law students, might face the toughest hurdles in ensuring publication of only high quality empirical studies and in implementing and enforcing disclosure policies. Learning Intentionally And The Metacognitive Task, Patti Alleva, Jennifer A. Gundlach

This article serves both to frame The Pedagogy of Procedure symposium it introduces and to itself explore the importance of metacognition and learning about learning to legal education and lawyering. The authors begin by suggesting why Civil Procedure doctrine is so challenging to teach and learn, noting how the symposium pieces help to tackle those challenges. They then join the growing number of law professors who advocate that learning how to learn deserves greater attention in the law school curriculum, suggesting that law schools should do more to demonstrate respect for the process of learning as an end in itself. …

Institutionalizing Legal Innovation: The (Re)Emergence Of The Law Lab, Martha F. Davis

As the terrain for legal education shifts, law schools are looking across disciplines for new approaches to legal education, with a number of law schools recently establishing “law labs.” This article examines this new law lab movement, with a particular focus on the subset of legal innovation labs. Law labs were originally proposed as part of the legal realist-era law clinic movement, and there are many parallels between law labs and traditional clinics. For example, both law labs and clinics borrow terminology and specific methodologies from the sciences, particularly medicine, and both arise in reaction to the entrenched case method …

This Article offers an empirical answer to a question of interest among scholars of comparative international law: why do American views about international law appear at times to differ from those of other countries? The authors contend that part of the answer lies in legal education. Conducting a survey of the educational and professional backgrounds of nearly 150 legal academics, the authors reveal evidence that professors of international law in the United States often lack significant foreign legal experience, particularly outside of the West. Sociological research suggests that this tendency leads professors to teach international law from predominantly nationalistic and …

This article attempts to describe and analyze those events which fostered the historical metamorphosis of the French legal studies curriculum. The predominance of a broad academic approach to law and the concomitant absence of a narrow "trade school" mentality in the French law schools might be attributed to the general organization of higher education in France. One of the primary contentions of this article is that the fundamental character of French legal education, which emphasizes the educating of jurists as opposed to the training of lawyers, is the product of a set of factors which are deeply rooted in French …

The Eason-Weinmann Colloquium entitled "The Internationalization of Law and Legal Practice," held in March 1988, addressed the challenges posed to conventional legal practice and rules of law by the evolution of the international marketplace. In light of the increasingly international character of commercial transactions, could or should disputes in transnational business ventures be adjudicated exclusively within national processes and according to domestic strictures? At the end of February 2015, law professors, law deans, incubator staff and attorneys, and self-selected others gathered at California Western School of Law for the Second Annual Conference on Law School Incubators and Residency Programs. The incubators that are the subject of this article tend to focus on transition to law practice and access to justice, and some are also working to incorporate technology for the practice of law as a means of enhancing access to justice. This article explores the purpose, structure and experience of doctoral studies in Canadian law schools. Relying on an auto-ethnographic methodology where we draw on our personal experience as doctoral students, we identify three tensions in doctoral studies in law. We explore how these tensions-between practice/theory structure/space, and supervisory/other relationships-emerge from the structure of doctoral studies in law and how they manifest themselves in the lived experience of doctoral students. We detail how these tensions are a product of the ambiguous and underexplored nature ofdoctoral studies in law. Among the more important decisions a law teacher makes when preparing a new course is what materials to assign. Criminal procedure teachers are spoiled for choice, with legal publishers offering several options written by teams of renowned scholars. This Article considers how a teacher might choose from the myriad options available and suggests two potentially overlooked criteria: weight and price.

Legal education is not just about attaining an abstract knowledge of formal institutions, norms, and processes; it is also about developing insight into oneself and ones relationships. Therefore, understanding and developing the personal and social conditions that make governance through law possible are crucial elements of legal education. This article highlights legal education's potential role in fostering every person's sense of implication in-and responsibility forbuilding a just society In order to illustrate this concept, this article looks at the ways in which DADs, a support group for separated and divorced fathers, constitutes a site of legal education.

This Article reports on an empirical study of the prevalence of Ph.D.s on law faculties, the rate at which J.D.-Ph.D.s are being hired by those faculties, the impact of that hiring on faculties’ legal experience levels, and the likely resulting future composition of law faculties. Approximately 29% of the tenure-track faculties of the top twenty-six law schools currently hold Ph.D.s, and 67% of those schools’ entry level hires in 2014 and 2015 are J.D.-Ph.D.s. Recent hiring has separated into two tracks. On the growing J.D.-Ph.D. track, both legal experience and preparation time is declining. On the fading J.D.-only track, legal …

Being a cost-effective researcher is not necessarily just about the legal research resources available where an attorney practices. Budgetary concerns are prevalent across all legal markets, from solos and public interest to large law firms. As the legal field struggles with clients who want greater efficiencies from their attorneys and alternative fee arrangements, many of which state that attorneys will not bill clients for legal research database fees, it is becoming more important than ever to teach law students and attorneys how to use alternative resources effectively and efficiently.

Medicine, like law, is sometimes referred to as a “conservative” profession, as both can change slowly, stifling innovation. While the art of medicine has produced important advances, there is at least one part of medicine that has not changed much in more than 100 years. Nearly all American medical schools have followed much the same educational model since Abraham Flexner published his famous report on the state of American medical education in 1910. The educational model promoted by that report emphasizes teaching students the science of medicine, but it is not well equipped for teaching students about the practicalities of …
